YTN told the story of a driver who was abused by an LG Electronics executive a while ago.

This time, it was revealed that the president of Hyundai Department Store, a large company, harassed the attendants by telling him to take him to illegal nightlife during the gathering ban.

Some drivers became ill in the process.

This is an exclusive report by reporter Kim Cheol-hee.

In front of a cafe in Nonhyeon-dong, Seoul.

Even in broad daylight, the door is firmly closed.

[인근 업체 관계자 : (영업하는걸) 못 봤어요, 요즈음은 못 봤어요. 한참 못 봤어요.]

It turned out that this place with a cafe sign was registered as a general restaurant and was operated as an unlicensed entertainment pub where female employees served customers.

For this reason, he was caught one time and was suspended from business.

Despite this, the business operated secretly to avoid crackdowns until last month, when the ban on gatherings was imposed.

During this period, it was confirmed as a result of YTN coverage that Mr. A, the president of Hyundai Department Store, visited frequently using his company car.

We stayed here for about an hour and a half from 10 pm on the 29th of last month, and we stopped by late at night on the 10th, 18th, and 20th of the same month for over two hours of drinking.

Last September, I visited four times.

This is ‘the tip of the iceberg’, and the attendants of President A agree.

In the two years from 2017 to 2019, before the COVID-19 crisis, there were at least a hundred or more visits to the nightlife.

Until President A’s drinking party at the illegal establishment was over, the attendants had to wait outside.

As a result, overtime has become a daily routine.

[C 씨 / 전직 수행기사 : 들어가면 이제나저제나, 언제 나올지도 모르니까 주변에서 대기하고 있는 거죠. 새벽 2시에 나오겠구나, 여지없이 그 시간에 나와요.]

As YTN coverage began, President A admitted to violating quarantine rules.

In a statement issued in the name of Hyundai Department Store, President A apologized, saying that it was his fault for going to an illegal entertainment establishment, regardless of the reason.

However, he explained that he did not know about the illegal business.

However, as President A admitted that he had entered illegal entertainment establishments, a police investigation into allegations of violating the Infectious Disease Prevention Act seems inevitable.

As such, while the president of Hyundai Department Store violated quarantine rules by visiting illegal entertainment pubs from time to time, the attendants had to wait impatiently.

However, due to the comprehensive wage system that set an upper limit for monthly wages, they had to actually do ‘free work’ after a certain amount of time.

Then, reporter Lim Seong-ho reports exclusively.

Whenever Mr. A, the president of Hyundai Department Store, went to an illegal entertainment establishment to drink, the attendants had to work until dawn.

There was a case where I worked over 34 hours in four days.

[B 씨 / 전직 수행기사 : 회사에서 지급되는 초과 수당은 15시간. 15시간을 빼면은 거기서 보통 한 25시간 정도 더 일하게 된 거죠.]

Working an average of 40 hours per week and an average of 160 hours per month is a daily routine.

However, the monthly salary was always in the low 3 million won range.

It was because of the ‘comprehensive wage system’ contract with the dispatching company.

No matter how long overtime worked, only 15 hours per week, 66 hours per month on average, and an allowance of 800,000 won were recognized.

[B 씨 / 전직 수행기사 : (포괄임금제로) 통으로 묶었으니까 추가 수당은 없다….]

[C 씨 / 전직 수행기사 : 출퇴근하는 사람이랑 늦게 끝나는 사람이랑 급여가 똑같으니까 솔직히 기분 나쁘죠. 그거에 대해서 총무부에다가도 얘기했는데 (추가 수당은) 단 1원도 없고….]

This is clearly against the law, labor experts point out.

This is because non-payment of wages for work beyond the set contract hours is regarded as unpaid wages.

In fact, the Supreme Court also decided that even if the contract was a comprehensive wage system, additional pay should be paid for overtime work beyond the contract.

[김남석 / 변호사 : (초과 근무에 대해서도) 추가로 지급해야 하고, 만약에 지급을 안 하면 그것도 임금체불이 되고요. 포괄임금제 자체가 근로기준법에 맞게 계산이 돼야 하거든요?]

In response, Hyundai Department Store practically admitted that it had been unfairly paying low salaries to executives.

At the same time, he said that he would improve the system so that attendants would not suffer any disadvantages in the future.

The comprehensive wage system, which used to be focused on occupations where it was difficult to accurately calculate working hours, such as trainees and security guards, is now widespread enough to be introduced by more than half of companies.

As long-time working hours and delayed payment of wages continue to be controversial, it is pointed out that fundamental institutional improvement beyond short-term enforcement is urgent.
