[사회]Even if the ‘Daejang-dong Special Prosecutor’s Office’ is introduced, the ‘conclusion before the election’ is unknown

As it was mentioned that even Democratic presidential candidate Lee Jae-myung could accept a special prosecutor over the suspicion of preferential treatment for the development of Daejang-dong, attention is focused on whether it will become a reality.

However, even if the ruling and opposition parties agree to introduce a special prosecutor within this month, it is unclear whether the results of the investigation will come out before the March election next year.

The special prosecutor is a system in which an outside attorney is appointed as a special prosecutor instead of a prosecutor in cases where political neutrality and fairness are particularly required and the investigation and prosecution are entrusted.

If the Special Prosecutor’s Office Bill is passed by the National Assembly, the president appoints a special prosecutor in accordance with the law and conducts investigations within a set period and scope.

However, even if it is passed by the National Assembly, the investigation does not start immediately.

Excluding the ‘Sewol Special Prosecutor’s Office’, which ended without prosecution, the ‘Drooking Special Prosecutor’s Office’, ‘Gukjeong Nongdan Special Prosecutor’s Office’ and ‘MB Naegok-dong Brother-in-law’s Special Prosecutor’s Office’ are the most recent special prosecutor investigations.

If you look at the time it took from the passage of the Special Prosecution Act to the appointment of the special prosecutor at that time, it took as little as two weeks and as long as over a month.

This is the time spent by the opposition and opposition parties tug-of-war over a candidate for a special prosecutor to recommend to the president, and even if the special prosecutor is appointed after labor, they have to go through an investigation preparation period for another 20 days.

The special prosecutor’s office is set up, the special prosecutor’s assistant is appointed, and an investigation team including prosecutors and investigators is formed.

Looking at these past cases, it is predicted that even if the Special Prosecution Act passes the National Assembly within this month, an actual investigation will be possible at the end of this year at the earliest or early next year at the latest.

Also, considering the period of the special prosecutor’s investigation, which is usually 60 days, which can be extended by 30 days once with the approval of the president, it is impossible to guarantee whether the results of the investigation will be released before the presidential election on March 9 next year.

It is possible to use the permanent special prosecutor’s method instead of a separate special prosecutor’s method, but this also takes the same amount of time physically.

Despite these restrictions and controversy over effectiveness, the high voices calling for the introduction of a special prosecutor are largely due to distrust in the current prosecutor’s investigation.

The prosecution, which has been criticized for procrastination and poor investigation from the beginning of the investigation, has been burdened with the burden of carrying out investigations along with the growing theory of the introduction of the special prosecutor.
