[영상] “It’s a daughter, but…” Supreme Court overturns the lower court’s judgment on the death of a 3-year-old girl in Gumi

(Seoul = Yonhap News) The mother of the ‘death of a 3-year-old girl in Gumi’ has been tried again.

On the 16th, the Supreme Court overturned the original sentence of 8 years in prison and returned the case to the Daegu District Court in the appeal of Seok (49), who was charged with abduction (abduction) of minors and attempted corpse concealment.

The Supreme Court agreed that the deceased girl was the patriarch of Mr. Seok, but rejected the charge of swapping.

The Supreme Court said, “What the genetic analysis results prove is only the fact that the girl (dead girl) in this case can be regarded as the defendant’s biological parent, and the fact that the defendant took the victim (abducted girl) by exchanging it for the girl in this case. “No,” he said, adding, “There are still questions that make us hesitate to convince ourselves that we are guilty of the charges.”

“In order to determine whether the accused’s conduct constitutes abduction, additional hearings are needed on the purpose and intention of the accused, the circumstances at the time of the act, the mode and type of the act, the means and methods, and the victim’s condition,” he added.

Seok was accused of secretly exchanging a girl born to his own daughter Kim (23) at an obstetrics and gynecology clinic in Gumi between the end of March and early April of 2018.

He is also accused of trying to move the body of a child in a box to be buried in Kim’s villa on February 9, last year, one day before the death of a 3-year-old girl was reported to the police.

This child died after being left unattended in an empty house when Mr. Kim moved six months ago.
