[집중취재M] Three years of lease law, two years, unfortunately, the tenants were protected…

The ‘Lease 3 Law’ was created to protect tenants from being evicted when jeonse prices rise sharply.

However, as the new government announced that it would repeal or reduce the law, it is again being controversial.

It has now been two years since this law was enacted.

What changes have occurred in between?

First, reporter Kim A-young met the tenants and landlords in person and listened to their voices.

An apartment in Gangseo-gu, Seoul.

The price of 114 square meters jeonse was 600 million won two years ago, but it has risen to 800 million won these days.

This tenant signed a contract for 630 million won last year.

My two-year contract expires this fall, and I can’t afford to move elsewhere.

“The children’s school problems or their parents live over there, not far from here, so we can’t stay far away.”

(Because of parenting issues?)

“Yes.”

So, I plan to use the right to request renewal of the lease 3 law.

If you raise it up to 5%, you can live 2 more years.

5% of 630 million won is 31.5 million won.

That money is a burden, but it’s the best for now.

“If it’s big, it’s big and if it’s small, it’s small. If you ask for a 5% increase, it’s difficult, but you have to prepare it.”

Some tenants have already used a renewal claim once.

It was useful when the jeonse price soared, but I am worried about the next two years.

This is because the renewal request voucher can only be used once.

“If you go up, then you will have to move. Because my parents are close, I want to live as much as possible.”

Unlike tenants, landlords are very dissatisfied.

Because you don’t get what you pay for.

“There was a difference of 300 million won between the market price and the amount we contracted.

So, there are homeowners who pressure the tenants to come in and live on their own.

In this case, the tenants will raise it above the 5% upper limit, and they may just negotiate with the landlord.

“If the owner gives me 100 to 200 million won cheaper than the market price, I try to negotiate a new contract even if I pay a little more.”

Some landlords even drive out the tenants who wanted to come in and live in, and secretly bring in other tenants.

[안정철/임대차 소송 변호사]

“(The tenant) found it after looking at it for several months. I think he signed a contract with a new tenant. We’ve caught it, and we’re preparing a civil lawsuit.”

As a result of analyzing the top 100 apartments in Seoul by the Ministry of Land, Infrastructure and Transport, the contract renewal rate, which was 57%, has risen to 77% within a year after the enforcement of the 3rd Lease Act.

Unfortunately, it means that it helped the tenants not to be evicted immediately after two years.
