A ‘New Freedom Solidarity’ flag is hung at the incense burner in Itaewon… Dismissal of the court’s temporary injunction

The Council of Families of Those Bereaved by the 10.29 Itaewon Tragedy (Council) applied for a temporary injunction to prohibit access within a 100m radius of the civilian incense burner of Noksapyeong Station against the New Freedom Coalition, which put up a banner criticizing the opposition in the meeting civil memorial service for the Itaewon massacre, but was not accepted.

On the 6th, the 21st Civil Settlement Division (Chief Judge Lim Jeong-yeop) of the Seoul Western District Court rejected the application for an injunction to prohibit access filed by the bereaved family council against the New Freedom Solidarity.

The judge said, “The main content (of the banner put up by the New Freedom Solidarity) is to criticize a politician or a specific political party, and it cannot be considered as one that criticizes the deceased or bereaved families directly from the Itaewon disaster. ” Denying the freedom of assembly of the New Freedom Solidarity is rather an excessive restriction on fundamental rights.” He continued, “It cannot be said that the right to pursue happiness or the right to the personality of the creditor (council) is absolutely superior to the freedom of the debtors to assemble.”

Previously, on December 29 last year, the bereaved family council filed an application for a temporary injunction to block the New Freedom Solidarity’s access to the incense burner. At the preliminary injunction hearing on the 17th of last month, the bereaved family council said, “According to the right to pursue happiness under Article 10 of the Constitution, the bereaved family has the right to form a peaceful feeling of remembering the deceased. “They infringe on personal rights by giving the impression that they are biased towards political forces.”
