After the verdict, he claimed that it was “an act of destruction of property, not sexual harassment,” and requested that the dismissal be canceled.
In particular, he asserted, “The choice of which device to use for masturbation is a sexual freedom that belongs to the right to sexual self-determination and the right to pursue happiness.”
However, the court did not accept this, saying, “The act of making the other person feel sexually humiliated or disgusted is sexual harassment.”
The court emphasized, “This case of sexual objectification of a specific co-worker cannot be viewed as simply staying in the sexual realm of an individual that belongs to the plaintiff’s right to sexual self-determination and pursuit of happiness.”
He also judged that “it was a very serious and repeated offense that undermined not only the plaintiff himself but also the public’s trust in the public service society.”
