Court “Party to suspend doctor’s license for reusing ‘suction tip'”

A doctor whose license was suspended for reusing disposable ‘suction tips’ used for dental treatment and procedures filed a lawsuit, claiming that the disposition was excessive, but lost.

According to the legal community on the 21st, the 5th administrative division of the Seoul Administrative Court (Chief Judge Jeong Sang-gyu) ruled against the plaintiff in a lawsuit filed by dentist A against the Minister of Health and Welfare, saying, “Please cancel the license suspension.”

Person A was found to have reused disposable suction tips at his dentist from December 2019 to April last year, and received a six-month doctor’s license suspension from the Ministry of Health and Welfare.

A suction tip is a plastic medical product attached to the end of a ‘suction’, a machine that sucks in foreign substances in a patient’s mouth, and functions to help suction of saliva and blood.

In the lawsuit, Mr. A argued, “After disinfecting and reusing the suction tip, there was no harm to the patient and no unreasonable profit was taken.

However, the court found that the ministry’s decision was justified.

The court said, “Doctors’ medical practices have a large impact on public health and public harm, requiring a high level of caution. There is a high risk of undermining the medical order,” he said.

“In particular, the suction tip is a plastic consumable, and it is not easy to sterilize because it is weak to high pressure and high temperature.
