An acquittal was handed down to a 40-year-old who went to court for assault after an argument with a user who was unhappy after drying himself with a hair dryer in the gym’s locker room.

The Chuncheon District Court Criminal Division 1 (Chief Judge Kim Cheong-mi) announced on the 1st that it had acquitted A (48), who was charged with assault, as in the original trial.

Person A then called 112 and called the police, and when Mr. B tried to leave the gym, he blocked the entrance to the building’s elevator.

When A received a summary order for fines for assaulting B by pushing her breast in the process, she requested a formal trial in the court.

The court of first instance accepted Mr. A’s claim that he was trying to prevent Mr. B from leaving the scene before the police arrived, but had no intention of assault, and judged that it was an acceptable level of action according to social norms. To this, the prosecution appealed, saying that it cannot be regarded as a legitimate act.

However, the appellate court also dismissed the prosecution’s appeal, saying, “From the perspective of the accused who suffered threats, it seems necessary to take minimal measures to prevent Mr. B from leaving the scene before the police arrived.”

On the other hand, B was confirmed after receiving a summary order for fines for threatening A.
