EPFO freezes senior pension; RC Gupta back to court

Kozhikode ∙ In the PF pension case, RC Gupta, who paved the way for many people to get higher pensions, went to the Supreme Court again against EPFO​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​ The judgment of the Supreme Court in the case of RC Gupta in 2016 was that the deadline for giving the option of a higher pension was incorrect and that the option should continue to be accepted. According to this he received a higher pension.

EPFO ​​has now sent a notification suspending the pension by interpreting the decision of the Supreme Court which upheld the judgment of the RC Gupta case on November 4 and said that there is no opportunity to give a new option to those who retired before September 1, 2014. .

RC Gupta, who retired from Himachal Pradesh Tourism Development Corporation (HPTDC) as General Manager in November 2008, got the option in 2016 as per the Supreme Court ruling. The reason for suspending the pension is that it is an option given after September 2014 after retirement.

RC Gupta said:

EPFO files 2 cases against the act. These are against pension suspension and defamation without sending a notice or waiting for a reply. My organization has been paying in proportion to the actual salary since the beginning. The option under paragraph 26(6) is required at the time of joining the service. According to this, the higher proportion is paid. It’s a big joke to ask you to file a copy of that option in person online years after retirement. This act is unjustifiable and arbitrary.

The Supreme Court has noted this option in its judgment dated October 4, 2016. The option under paragraph 11(3) and 11(4) was also given following the court order. EPFO ​​is directed to grant new option within 15 days of receipt of notification along with joint option grant document under 11(3) before 2014. No one in HPTDC Pensioners Welfare Society intends to give the new option as the option has already been given as per the order of the Supreme Court. Proceed with the case.
