The dismissal of Park Jeong-hoon from his position as the Chief Investigating Officer of the Marine Corps occurred during his investigation into the death of Corporal Chae. Today, the first hearing was held regarding Park’s application to stop his dismissal. The Suwon District Court has set the date for the first hearing on the application to stay the execution of Park’s dismissal, which was filed against the Marine Corps commander, at 11:00 am today.
Park’s legal team argues that if the dismissal is carried out, irreparable damage will be inflicted upon him. Even if Park succeeds in future legal proceedings to invalidate his dismissal, he would be unable to fulfill his duties for a significant period of time due to the nature of his position, which has a fixed term. Additionally, they assert that this dismissal could fundamentally undermine the independence of the military police.
Commenting on the situation, lawyer Kim Jung-min, representing Park, stated, “We are now starting to receive judgments from our judicial system and private judiciary. Based on the concerns and judgments of the public, we believe that rational decisions will be made.”
As for the decision to file a lawsuit without exhausting the personnel appeal process, Park’s legal team claims that the Minister of Defense has been pressuring the complainant in various ways, making the appeal process ineffective.
At the scene of the hearing, members of the Marine Corps who were with Park during the arrest warrant review, as well as the families of deceased soldiers stationed at the military base, such as the late Sergeant Lee Ye-ram’s family, were in attendance.
Previously, Park had reported the accident investigation report on Corporal Chae of the 1st Marine Division to Defense Minister Lee Jong-seop and handed it over to the civilian police before being dismissed from his position.
While the former director Park is currently under investigation by the military prosecutor’s office, he has not been detained since the court dismissed the arrest warrant for the charge of rebellion on the 1st.
Tomorrow, former director Park is expected to respond to the request of the Yongsan National Defense Prosecutor’s Office to appear.
