This is a text message from former national short track team coach Cho Jae-beom to Shim Suk-hee.

Evidence to support the victim’s testimony, such as text messages, played a major role in the background of Cho’s conviction in the first and second trial on charges of committing a sex crime against Shim for over three years.

According to the verdict, on August 29, 2014, Cho found out that Shim had a boyfriend and became angry when he inquired in detail about whether he had physical contact or not. After calling him home, he beat him all over the body with his fists and feet.

Cho made Shim to his knees and slapped him on the cheek several times, saying, “If you desperately need (continuation of your athlete’s career), let’s have sex with me.”

Shim stated in his training diary that he had suffered damage from Cho for the first time about a week after he had been to Canada’s field training at the time.

He explained in detail the circumstances at the time, including the situation in which he was hit hard from the head to the wall.

In addition to this, it was found that the statement regarding the damage over the past three years was made concrete by referring to the schedule of events such as the World Championships, the official training schedule for the national team, immigration records, and KakaoTalk and Telegram messages.

The court found that there was no reason to doubt the credibility of Shim as he clearly stated the date and place, Jo’s actions, and his psychological state at the time.

In the second trial, “I have had sexual intercourse under consensual agreement”

Looking at the forensic results, Mr. Cho told Shim, “If you come, give yourself to the teacher (teacher)”, “There is no need for it, after all. You are not ready to give yourself up. (Omitted) You can throw it away.”

The court decided that it was difficult to see this as a normal conversation between a teacher and a disciple.

In addition, during the police investigation, Mr. Cho did not give any answers about the forensic results, but when he went to the prosecution, he made a statement to the effect that it was a simple joke, which I found difficult to understand from the point of view of the general public.

In the first trial, Cho denied the allegation, saying, “I have never committed a crime,” but in the second trial, he suddenly changed his statement, saying, “I had sexual intercourse under consensual agreement.”

However, the court judged that Shim, who is known by name, seemed hesitant about the possibility that the contents of the sexual offense would become known to the public, and then decided to file an additional complaint.

Several witnesses testified that Cho was monitoring Shim’s cell phone, censoring it, and checking the contents of KakaoTalk messages on a computer.

Also, about 2015-2016, Shim said, ‘Sexual harassment, sexual assault (omitted), dual personality personality disorder… The verdict was judged on the basis of relevant evidence, such as a memo written ‘I can’t stand it’.

The Suwon District Court of the first trial sentenced Cho to 10 years and 6 months in prison in January, and the Suwon High Court of the second trial last month sentenced him to 13 years in prison.

On the other hand, Shim was recently separated from the national team after being embroiled in controversy that he demeaned his teammates and deliberately attempted to collide with Choi Min-jung during the Pyeongchang Olympics.

This controversy arose when the contents of the ‘attorney’s opinion’ submitted by the Cho side to the second trial court in July were released through a media outlet.
