Judicial ‘Interim order only, part of government will inform court again’: Vijayaraghavan

Vijayaraghavan added that he had seen how the central agencies were functioning just before the assembly elections and that this had caused a great deal of protest among the people.

Kochi: CPM Acting Secretary A Vijayaraghavan said that the decision of the state government to conduct a judicial inquiry against the Central Investigation Agencies was taken after a legal examination. The investigation was stayed only by an interim order. Once the decision is accepted, the government will again inform the court of its side. Vijayaraghavan added that he would look into whether it was possible to avoid the stay and move forward.

Retaliation to Government, Interim Stay for Judicial Commission Inquiry against Central Investigation Agencies

The interim stay order came in response to the state government’s decision to hold a judicial inquiry against the central investigative agencies in connection with the gold smuggling case. After considering the petition filed by the Enforcement Directorate, the High Court accepted the petition on file and informed that the detailed argument would be heard later. Opposition parties will not send a notice to the Chief Minister. But notice will be sent to other parties.

The ED had filed a petition seeking quashing of the appointment of Justice VK Mohanan Commission. The ED argued in the petition against the appointment of the Judicial Commission that the state government did not have the power to appoint a Judicial Commission in a case involving a central agency and that a parallel inquiry was not appropriate. The government’s position was that ED had no authority to approach the court. The court rejected this and issued an interim order.
