Not getting married after sexual intercourse is not cheating: Court | Bombay Highcourt

Mumbai നിരീക്ഷ The Bombay High Court has acquitted the accused in a 25-year-old torture case, observing that refusing to marry after years of physical contact is not a crime of cheating. The court overturned the sentence, saying there was no evidence to suggest that the sexual intercourse was consensual and that it was motivated by the misconception that marriage was possible. The complainant had admitted in court that she had been in physical contact for more than 3 years. The girl’s sister also said that the two were in love.

In the 1996 complaint, the police had registered a case for torture and fraud. After a three-year trial, the sessions court dismissed the torture charge and sentenced him to one year in jail and a fine of Rs 5,000 for fraud. The accused approached the High Court against this.
