Park Yoochun, let him be active in domestic broadcasting and entertainment… court dismissal

An application to remove the injunction of a decision to prohibit activities was refused

Singer and actor Park Yoochun applied to cancel the court’s temporary ban on broadcasting and entertainment in Korea, but it was not accepted.

According to the legal community, the 50th Civil Agreement of the Seoul Central District Court (Chief Judge Song Kyung-geun) rejected Park’s request to ‘cancel the injunction against appearing in broadcasting and entertainment activities’ on the 27th.

Entertainment agency Yespera (now Have Fun Together), entrusted with Park’s management, filed an injunction with the court in August last year, claiming that Park had breached her exclusive contract and promoted activities with a third party.

The court accepted Yespera’s request and ordered, “Until the judgment on the original case is completed, Park Yoochun must not produce, promote, publicize, feature, appear, or participate in entertainment activities for third party other than Yespera.”

After that, instead of filing a new lawsuit, Yespera added a request to ban broadcast appearances and entertainment activities to the lawsuit for damages pending against Park in the same court.

In response, Park’s side said that this method was not legal and that Yespera did not comply with the court’s order to file a lawsuit on the merits within the time limit, so she applied to the court to cancel the decision of the injunction.

However, the court interpreted, “The basis of the claim for damages for breach of Park’s exclusive contract and the request for a ban on broadcast appearances and entertainment activities are the same.”

The change in the purpose of Yespera’s claim is that it can be seen as filing a lawsuit on the merits of the injunction decision.

The court added, “There is no reason to consider that the change of claim is illegal or constitutes an abuse of rights.”

Park was arrested in 2019 on charges of using methamphetamine and was sentenced to 10 months in prison and 2 years of probation.

Before being charged, he held a press conference to announce his retirement from the entertainment industry, but reversed this and returned to broadcasting after a year.

He was supposed to return to the screen after five years with the film ‘Dedicated to Evil’, which will be released next month, but it seems that today’s court decision will put the brakes on him.
