‘Secular Unified Law on Marriage and Divorce’

Kochi: The High Court has said that it is time to break the marriage laws in the country. Secular Unified Law should replace the personal law for marriage and divorce. A division bench comprising Justice Mohammad Mushtaq and Justice Kauser Edappagath observed that the unified law was the need of the hour.

The court granted the divorce at the request of the wife of a young man from Kozhikode and a real estate dealer.

The court observed that forcible sexual intercourse without the consent of the partner could be considered a cause of divorce, and expressed strong opposition to aggression on the grounds that the wife’s body was her own. Marital persecution is an encroachment on individual freedom and privacy. The court ruled that divorce could not be denied to those who suffered in this way.
