The amendment to the Public Prosecutor’s Office Act, a so-called ‘completely deprived of the prosecution’s investigation authority’, passed the plenary session of the National Assembly on the 30th.

If the amendment to the Criminal Procedure Act is processed by the 3rd of next month at the earliest, the legislation that the Democratic Party is pushing for will be finalized.

The National Assembly held a plenary session at 4:22 pm on the same day and voted to amend the Prosecutor’s Office Act to reduce the crimes subject to investigation by the prosecution from the existing six major crimes to corruption and economic crimes.

The bill was passed with 172 votes in favor, 3 against, and 2 abstentions.

In the Democratic Party, 161 people attended and voted in favor, excluding incumbent State Councilors including Justice Minister Park Beom-gye, Rep. Song Young-gil Oh Young-hoon who resigned due to running for local elections, and Lee Kwang-jae, a member of the National Assembly, who was diagnosed with Corona.

In addition, six members of the Justice Party and independents of the Pan-Passport Party also participated in the vote in favor.

Among the three members of the People’s Party, Rep. Lee Tae-gyu and Choi Yeon-sook were against it, while lawmaker Kwon Eun-hee, a former police officer, supported it.

Rep. Cho Jung-hoon of the transition of the era pressed against, while Rep. Yong Hye-in of the Basic Income Party and Rep. Yang Hyang-ja, an independent from the Democratic Party, abstained.

People’s Power did not participate in the vote, saying that the Democratic Party and National Assembly Speaker Park Byeong-seok were forced to vote on the bill unilaterally.

Instead, they stood up from their seats or gathered in front of the podium, shouting and expressing their strong will of protest.

The amendment was proposed at the plenary session on the 27th. The power of the people tried to stop it with a filibuster (unlimited discussion), but as the Democratic Party responded with a ‘salami tactic’ that splits it into one-day sessions, the debate ended with the end of the session at 12:00 on the same night.

A vote was immediately taken at the plenary session on the same day that the new extraordinary session of the National Assembly began.

This is in accordance with the National Assembly Act, which stipulates that if the unlimited debate is concluded at the end of the session, the relevant agenda must be voted on without delay in the next session.

As the Democratic Party plans, if the bill passes the cabinet meeting during the Moon Jae-in administration’s term, the scope of the prosecution’s direct investigation will be reduced from the existing six major crimes to the second major crimes (corruption and economic crimes) from September.

In addition, the investigative prosecutor and the prosecution prosecutor are separated, and the Prosecutor General must report to the National Assembly on a quarterly basis on the status of the front-line investigation department in charge of corruption and economic crime investigations and prosecutors.

The Democratic Party immediately proposed another amendment to the Criminal Procedure Act, another oversight bill.

The amendment to the Criminal Procedure Act stipulates a ‘prohibition of special investigations’ and aims to exclude the accuser from the right to object to the police investigation.

The People’s Power once again applied for a filibuster. Starting with Rep. Kim Hyung-dong from People’s Strength, Assemblyman Choi Ki-sang from the Democratic Party, and People’s Strength Assemblyman Mi-ae Kim, etc., started the debate in turn.

Even during the discussion, protests erupted from the seats or pointed at each other.

Due to the shortened session led by the Democratic Party, the second filibuster will also automatically end at 12:00 pm on the same day.

The Democratic Party plans to hold an extraordinary session of the National Assembly again on the 3rd of next month, three days later, to vote on amendments to the Criminal Procedure Act.

If this happens, the Inspection and Observation Legislation led by the Democratic Party will be finalized.

The Democratic Party is also accelerating the launch of the Judicial Reform Special Committee, which was included in the agreement following the arbitration of National Assembly Speaker Park Byeong-seok, and is poised to launch the Serious Crime Investigation Agency (Korean-style FBI) within one year and six months to take charge of major crime investigations instead of the prosecution.

Park Hong-geun, floor leader of the Democratic Party of Korea, said at the general meeting of the National Assembly held before the plenary session, “We must keep the agreements with greater responsibility and complete reforms of institutions of power.” “The agreement between the ruling and opposition parties to activate a private affairs committee should be pursued without delay,” he said.

He said, “In yesterday’s opinion poll, public opinion is changing, with more than half of the opinion that the prosecution reform should be pursued according to the original draft or the consensus plan. did.

On the other hand, floor leader Kwon Seong-dong of People’s Power said at the National Assembly, “The 171-seat Democratic Party has violated the National Assembly Act and the spirit of the National Assembly Advancement Act without even a single public hearing or discussion, and is enforcing the vicious law of scrutiny and strict opposition from the people.” If the relocation to the Blue House is a hundred years old, the problem of fixing the Korean criminal justice system can be said to be a thousand years old. It should be decided after sufficiently collecting public opinion and deliberation.”

He urged, “President Moon Jae-in should be a veto, not a beneficiary of the scrutiny. I hope that you will respond to the interview without hiding behind the barriers of people,” he said.

After the National Assembly, lawmakers from the People’s Power visited the Speaker’s Office in protest and shouted the slogan, “Stop the inspection.”
