[Y이슈][Y초점] “Yoo Ah-in is very likely to get a suspended sentence”… ‘Uhm Hong-shik drug scandal’ spotted by lawyers

Actor Yoo Ah-in (real name Um Hong-sik), who is accused of using four types of drugs, including propofol, hemp, cocaine, and ketamine, has been suspended from attending the police . It’s been about six weeks since the drug scandal broke, but he still keeps his silence. How do current lawyers see the trend of current cases? I asked three lawyers.

“Smart decision”

And, a current lawyer, evaluated the lawyers appointed by Yoo Ah-in as a ‘smart decision’. Attorney Sang-Woo Cha from the Infinity Law Company, appointed by Mr. Yoo Ah-in, a hot topic when it was revealed that he is a former prosecutor and works at Kim & Chang Law Firm, the largest law firm in Korea.

What is more notable is Attorney Park Seong-jin, who is the law firm’s representative lawyer and has been named in the defense team. He worked as a prosecutor for 28 years and was known as the best drug investigation expert in Korean prosecution. In 2000, he received a commendation from the Minister of Justice for his contribution to the fight against narcotics, and in 2006, he received long-term training from the United States Drug Enforcement Administration (DEA).

In particular, in 2013, it was widely known to the public by investigating the illegal propofol administration case involving actors Lee Seung-yeon, Park Si-yeon, and Jang Mi-in-ae.

Attorney A said, “For Mr. Yoo Ah-in, who is about to be investigated by the police, appointing lawyer Seong-jin Park, who is more familiar with drug crimes than anyone else, seems to be the best strategic choice.” “No one can change what the police have already investigated. However, when it comes to judicial matters, there are various methods of calculation.” In a situation where the current progress of the police investigation is covered with a veil, this is the surest hand for Yoo Ah-in to prepare for uncertainty.

“A suspended sentence is enough.”

Another lawyer, Mr. B and Mr. C, that the possibility that Yoo Ah-in would receive a test is high.

Attorney B said, “In Korea, drug offenders, especially first-time offenders, often get a delayed indictment. However, in the case of Yoo Ah-in, it would be difficult to delay the prosecution because he is a socially influential celebrity and has even inhaled cocaine, which is highly addictive.”

He said, “How regularly Yoo Ah-in took the drug and how much dosage will be the key to the level of punishment. In particular, Yoo Ah-in, who has no criminal record, is most likely to be sentenced to probation unless he is involved in the manufacture, sale, or mediation of drugs, which are factors of aggravating punishment, or constant drug use. ”

Attorney C also made a similar opinion. He said, “Unless Yoo Ah-in is actively involved in drug smuggling or habitually takes large amounts of drugs, it seems likely that she will receive a suspended sentence rather than a prison sentence.” He added, “A more conservative sentencing standard will be applied in a situation where the eyes of the public are focused, but if Yoo Ah-in shows an attitude of sincere reflection and there is no additional crime, a fine or a suspended sentence will be likely. .”

Yoo Ah-in’s drug scandal first came to light on the 8th of last month. At the time, it was known that he was being investigated by the police for frequent use of propofol. After that, the National Institute for Scientific Research made a detailed evaluation, and in his hair and urine, in addition to propofol, a total of four types of drug components were found, including hemp, cocaine and ketamine.

Afterwards, the police searched Yoo Ah-in’s residence, and also raided plastic surgery clinics in Gangnam-gu and Yongsan-gu, where he was given propofol and ketamine, and called his acquaintance and manager as references. During this process, the doctor who prescribed propofol to Yoo Ah-in was arrested as a red-handed criminal for illegally administering the drug himself.

The police have now banned Yoo Ah-in from leaving the country and are continuing the investigation without detention. Yoo Ah-in’s side postponed the police summons, scheduled for tomorrow (24th), and is coordinating future attendance schedules with the police.
