Bennett is seeking⁤ €7.4 million in damages from an Irish subcontractor, TEF, for alleged ⁤defective works and failure too complete a project. The dispute centres on issues that ⁤arose from January 2018, with TEF reportedly⁢ experiencing regular cash-flow problems and ceasing work on multiple occasions.

The contractual Framework and assignment

The foundation of Bennett’s claim lies in a platform that guaranteed the obligations and liabilities of the Irish subcontractor. This crucial collateral warranty and guarantee was assigned to Bennett in August 2024, providing a direct avenue ⁤for recourse.

A History of Delays and Financial Woes

According to Mr. Bruton, representing Bennett, TEF commenced works in January 2018. ⁢From the outset, various issues plagued the project, most notably⁣ TEF’s persistent cash-flow difficulties. These financial strains, Mr. Bruton stated, were a recurring ⁢problem for the subcontractor.

The situation escalated in January 2022, following the Christmas break.⁢ TEF failed to return to the site, despite the project already ⁢being substantially delayed. This abandonment of the works prompted a⁢ meeting between the parties. During this discussion, TEF admitted to experiencing financial difficulties and revealed that the works were no longer profitable for them.

Demands for Further ⁣payment and Allegations of Duress

TEF indicated that they would only resume work if an additional €850,000 was paid. Bennett claims to have already paid TEF⁢ a substantial €10.1 million. Furthermore, Bennett alleges that they paid another €625,000 “under duress” to persuade TEF to return to the site. while TEF did return, they allegedly failed⁤ to complete the works ⁢and subsequently left the site once more, according⁤ to Mr. Bruton’s account.

Breakdown ⁣in Dispute Resolution

The⁤ collateral warranty included provisions for dispute resolution through conciliation. Though, TEF reportedly⁤ refused to nominate a conciliator and rejected Bennett’s nomination.⁣ This impasse led to Bennett’s appointed conciliator resigning in December 2024, effectively stalling the agreed-upon⁢ dispute resolution process.

Extensive Remedial ⁢works and Claimed Damages

In the wake of TEF’s alleged failures, Bennett has undertaken extensive remedial works, engaging different subcontractors to ⁢rectify the situation. The total sum Bennett is claiming against the defendants for ⁢the cost of these remedial works amounts to €7.4 million.
