According to Masaki Takenaka, a lawyer specializing in consumer law based in Tokyo, the possibility of obtaining a refund after joining a multi-level marketing organization hinges on whether the enrollment was influenced by misleading information, undue pressure, or failure to disclose key contractual obligations.

Takenaka explained that under Japan’s Act on Specified Commercial Transactions, businesses engaged in door-to-door sales, mail-order sales, or multi-level marketing must provide clear written contracts and observe a cooling-off period during which consumers can cancel without penalty.

If a person joined such a scheme and was not given proper documentation, was not informed of their right to cancel within the legally mandated period—typically eight days from receiving the contract—or was subjected to aggressive solicitation tactics, they may have grounds to demand a refund even after payment.

The lawyer emphasized that the burden of proof lies with the consumer to demonstrate that the business violated disclosure requirements or used deceptive practices. Evidence such as recordings of solicitation calls, copies of unsigned or incomplete contracts, or witness testimony can strengthen a claim.

However, if the individual voluntarily joined after receiving full information and signed a contract acknowledging the risks, refunds become significantly harder to obtain, particularly if the cooling-off period has expired.

Takenaka noted that many multi-level marketing operators structure their operations to exploit legal gray areas, using complex compensation plans and vague product descriptions to obscure the true nature of the business model, which often relies more on recruitment than actual product sales.

Consumers who suspect they have been misled are advised to act quickly, gather all relevant documents, and consult with a consumer protection agency or legal professional. In Japan, the National Consumer Affairs Center provides guidance and can mediate disputes, while civil litigation remains an option for recovering losses.

The lawyer warned that time limits apply to legal claims, and delaying action may result in the loss of eligibility for refunds or compensation, urging individuals to seek advice promptly after recognizing potential harm from such schemes.
