Saudi ⁤Building Code Violations and Penalties

The Ministry of Municipalities⁣ and Housing has issued‌ a list to categorize violations of the Saudi Building Code in order to determine the ​process of controlling dangerous violations.

Penalties for Violations

Violators shall be punished with the heaviest punishment ⁣prescribed by law depending on the degree of seriousness of the violation and its effect​ on harming life, property, health or public order or the area, ​size and ⁢type of building, its cost⁢ of⁢ construction, importance​ of its location and area of ​​infringement.

Non-Hazardous‍ Violations

When a non-hazardous violation is detected, the relevant ‌authority takes ⁣two measures, the first is to inform the violator through the reporting procedure followed by ​law and ask him to remove or correct it in accordance with the ‌code. Within a maximum of‍ 30 days from the ⁤date of notification to ‍initiate correction or removal‌ of infringing works, while the maximum is 10,000 Riyals.

Penalties for Specific Violations

  • The owner will be punished with a fine of 10,000 riyals ‌if the construction‌ work is carried out without a contract with the supervisory​ engineering office authorized or licensed by the authority concerned with the exercise of supervision work,⁢ or⁢ if the construction work is carried out without agreement with ⁣an authorized or licensed contractor.
  • Failure⁣ to attach all the plans required by the Saudi Building ​Code at the‌ time of issuing‌ the license incurs a fine of 3,000 Riyals ⁣or 5,000 Riyals to⁤ the designer’s office, or 5,000 Riyals upon submission of the report. Violation of the Code and license‍ issued accordingly, or submitting a soil ⁣test⁢ that includes incorrect‌ information or assigned to land other than the land for which the license is issued.
  • The designer office will be fined 500 riyals for not submitting ​the soil test survey from the authorized office and 7 and a half thousand riyals for ‍requesting or issuing an occupancy certificate for ⁢the building despite its presence.‌ Violation of dangerous buildings according to code.
  • A fine of 9,000 riyals applies to the⁤ contractor, 6,000 riyals to the supervising office, and 3,000 riyals to the designer’s office in case‌ of not implementing the design, description⁢ or architectural work according to⁢ the building ⁢or facility code.
  • However, in case of non-compliance with the design, description, ⁤approval or implementation requirements of the construction work of the building or facility ⁢according to the code, or in case of implementation ⁢of⁣ the construction work in violation of the license and approved ⁣engineering plan according to the code, the contractor will be fined 10,000 riyals​ and ⁣the supervisory office 7,500 riyals. And the designing ⁢office has been fined 5 thousand riyals.
  • The contractor will be fined 10,000 riyals,​ 8,000 ‍riyals to the supervisory office and 4,000 riyals to⁣ the designer office if they do‍ not comply with the description, approval or implementation of the basic construction⁣ materials (eg: reinforcement steel or concrete) and do not ensure‌ their compliance with the ⁣approved ‌standard⁢ specifications.
  • The regulation states that the contractor will be fined 9,000 riyals, the supervisory office 6,500 riyals and the designed office 3,000 riyals if the ‌design, description, ⁢approval or implementation is not carried out. Does not conform to requirements or approved⁢ standard specifications for ​permanent and temporary electrical extensions and installations as per code.
  • If the design,⁣ description, approval ​or implementation is not done, the contractor will be fined 6,000 Rials, the supervisory office‍ will be fined 4,500 Rials and the designed office⁣ will be fined 2,000 Rials. Conditions for insulating and protecting the building or facility from rain‌ and surface water leaks and not operating watertight concrete floor tanks from​ the inside‍ against water leakage as per specifications and‌ technical requirements or codes.
  • The regulations fine​ the contractor ⁢10,000 riyals,⁤ the supervisory office 8,000 riyals and the ⁤designing office 6,000 riyals in case ⁢of non-compliance with the design, description, approval or implementation of technical requirements and requirements for ⁢energy efficiency plans, including thermal insulation of building as per code.
  • Failure to ‌implement the design, description, approval or technical requirements of ⁢the design will result in a fine of 3,000 riyals to the ‍contractor, 2,000 riyals⁣ to the supervisory office and 1,000​ riyals to the designing office. and implementation of installation and extension of sanitary ‍work ⁢system and rain water drainage system as per code.
  • If the technical requirements of smoke detectors and fire extinguishers are ​not designed, described,​ approved or implemented ‍according to the code, the contractor will be⁢ fined two thousand 250 riyals, the supervisory office. With⁤ one thousand 500 riyals and ‌designed office with 750 riyals.

Additional‌ Penalties

3,000 penalty for each⁢ report is expected from the supervising engineering office if the supervisory engineering office submits a construction phase supervision report inconsistent with reality.

In⁣ case of not complying with the safety‌ precautions contained in⁤ the⁣ code during the implementation of construction, ‍demolition or restoration ‌work, the contractor shall be⁤ fined two thousand Rials and the supervising ⁢office shall be fined one ​thousand Rials.

The ‌regulation states that if there is a⁢ violation⁤ of the requirements and requirements of the Saudi Building Code and a fine is not specified​ for ⁢it “and its value and degree of importance will be approved by‍ the committee,” its value will be‍ set ⁢at 1,000.⁢ Rial to 10,000 ⁣Rial.
