Sixty residents of the Kråkenes neighborhood in Bergen, Norway, have filed a lawsuit against a single neighbor following a dispute over a footpath that residents claim has divided the community.

The legal action centers on a walking path that has been used by the local population for an extended period. According to reporting by Bergensavisen, the conflict escalated after the defendant blocked access to the path, prompting a large group of neighbors to seek a judicial resolution.

The plaintiffs argue that the footpath serves as a critical link within the residential area. They contend that the long-term, consistent use of the path by the neighborhood has established a legal right of way through prescriptive easement, a legal principle known in Norway as “hevd.”

Under this principle, a person or group may acquire a legal right to use land they do not own if they have used it in a specific way for a required period of time, provided the use was consistent and not explicitly forbidden by the owner during that window.

The defendant has contested these claims, asserting that the land in question is private property. The individual argues that as the legal owner of the plot, they possess the right to fence off the area and restrict access to prevent trespassing.
