What is teh Digital Markets Act (DMA)?
The Digital Markets Act (DMA) is a European Union law designed to limit the market power of large online platforms, designated as “gatekeepers,” and promote fairer competition in digital markets. it was adopted in December 2022 and entered into force in November 2023, with most provisions becoming applicable on May 2, 2024.
The DMA addresses concerns that a handful of dominant tech companies control access to essential digital services, hindering innovation and consumer choice. It aims to prevent these “gatekeepers” from abusing their position by imposing obligations on them regarding interoperability, data usage, and self-preferencing. The European Commission identifies gatekeepers based on criteria related to their size, market capitalization, number of users, and control over core platform services.
On September 6, 2023, the European Commission designated six gatekeepers: Alphabet (Google), Apple, ByteDance (TikTok), Meta (Facebook), Microsoft, and Amazon. European commission press release. These companies face specific obligations under the DMA.
Which Companies are Designated as Gatekeepers?
As of January 20, 2026, the European Commission has designated the following companies as gatekeepers under the DMA:
- Alphabet (Google): Designated for its search engine, app store, advertising services, and Android operating system.
- Apple: Designated for its app store, Safari browser, and operating systems (iOS, macOS).
- bytedance (TikTok): Designated for its social network and online advertising services.
- Meta (Facebook): Designated for its social network, messaging service (WhatsApp), and advertising services.
- Microsoft: Designated for its operating system (Windows), office suite (Microsoft 365), and cloud services (Azure).
- Amazon: Designated for its marketplace, search engine, and cloud services (AWS).
The designation process is ongoing, and the European Commission can add or remove gatekeepers based on evolving market conditions. The criteria for designation are outlined in Article 3 of the DMA.
In December 2023, the European Commission opened market investigations into Apple and Google to assess whether they comply with the DMA. European Commission press release. These investigations focus on potential breaches of the DMA’s rules regarding app stores and self-preferencing.
What Obligations Do Gatekeepers Face?
The DMA imposes a series of “do’s and don’ts” on designated gatekeepers. These obligations aim to ensure fairer competition and greater choice for consumers and businesses.
Key Obligations Include:
- Interoperability: Gatekeepers must allow their messaging services to interoperate with smaller platforms, enabling users to communicate across different apps.
- Data Portability: Users must be able to easily transfer their data between platforms.
- Fair Access: Businesses relying on gatekeepers’ platforms must have fair access to data generated by their users.
- No Self-Preferencing: Gatekeepers cannot favor their own services or products over those of competitors.
- App Store Fairness: Gatekeepers must allow developers to use their own payment systems and promote their apps freely.
A detailed list of the obligations is available in the DMA’s official documentation. Non-compliance can result in fines of up to 10% of the gatekeeper’s total worldwide turnover in the preceding financial year, and up to 20% for repeated infringements.
On March 26, 2024, the European commission formally accused Apple of breaching the DMA regarding its App Store rules. European Commission press release. This marks the first formal inquiry under the new law.
What are the Potential Impacts of the DMA?
The DMA is expected to have meaningful impacts on the digital landscape, perhaps fostering greater innovation and competition. it could lead to more choices for consumers, lower prices, and increased opportunities for smaller businesses.
Potential Impacts Include:
- Increased Competition: By limiting the power of gatekeepers, the DMA aims to create a more level playing field for smaller companies.
- Greater Innovation: Fairer access to data and platforms could encourage new entrants and innovative services.
- More Consumer Choice: Interoperability and data portability will empower users to switch between platforms more easily.
- Reduced App Store Fees: The DMA’s rules on app store fairness could lower fees for developers, potentially leading to lower prices for consumers.
