Following the Russian invasion of⁣ Ukraine in 2022, aircraft leasing giant AerCap found itself in a challenging position – with a considerable fleet of planes stranded in Russia due to⁢ sanctions and the subsequent inability of Russian airlines to make lease payments. After a protracted legal battle,AerCap has now secured over $1.6 billion⁣ in insurance settlements and court awards related to these seized assets,⁤ marking a critically important recovery for the company and setting a precedent for other lessors.

AerCap, the world’s⁢ largest aircraft lessor, initiated legal ‍action to recover losses stemming from the inability to reclaim ⁣leased aircraft. The company’s proactive⁢ approach, particularly leading a group of lessors in a London High court case, has yielded substantial results.In June 2024,AerCap achieved a⁣ landmark $1.03 billion award⁣ in London, successfully ⁣suing insurers over‍ the seizure of its aircraft in Russia.This followed a 12-week trial involving five other aircraft lessors, with AerCap taking the lead. The legal team from Herbert Smith Freehills Kramer expertly guided AerCap through the complex proceedings.

This⁤ victory builds upon a $572 million full settlement secured in 2023, covering claims under the insurance policies⁤ of Russian carriers ural Airlines and S7 Airlines. This ⁤earlier settlement encompassed a total of 47 aircraft and five spare engines leased⁢ to⁣ these airlines at the time of the invasion.

Crucially, the recent settlements and the $1.03 billion award have been approved by both the US Department of Commerce and the US Department of the Treasury, ensuring compliance with international regulations.

Ongoing Recovery ⁤Efforts and Future Uncertainties

While AerCap has made significant strides in recovering its assets, the process isn’t entirely‍ complete. The company acknowledges that discussions are ongoing with insurers related to claims against ⁢other Russian airlines.

However, AerCap cautioned, “while⁤ insurance settlement discussions are ongoing with respect to some of our claims under the insurance policies of other ⁤Russian airlines,‍ it is uncertain whether any of these⁣ discussions will result in any insurance settlement or receipt of insurance settlement proceeds and, if so, in what amount.” A key concern ⁢remains⁣ securing the necessary approvals and⁣ funding to finalize any further ⁣settlements.

AerCap’s success is a testament to⁣ its strategic legal approach. The company engaged the international ⁢law firm Herbert ⁣Smith Freehills Kramer to represent them throughout the London proceedings.
