Malaysia’s proposed constitutional reform to split the powers of the Attorney-General and Public Prosecutor faces a two-week deadline for revisions following intervention by the Conference of Rulers. The Parliamentary Special Select Committee managing the legislation directed the Attorney-General’s Chambers to address specific concerns raised by the Conference of Rulers before the panel reviews the text again.
The legislative process involves the Constitution (Amendment) (No. 2) Bill 2026. Prime Minister Datuk Seri Anwar Ibrahim instructed Minister in the Prime Minister’s Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said to hold further consultations on the proposed constitutional amendments, according to Communications Minister Datuk Seri Fahmi Fadzil.
Attorney-General Chambers Given Two Weeks to Refine Bill
The Parliamentary Special Select Committee on the Constitutional Amendment on the Separation of the Roles of the Attorney-General and the Public Prosecutor held a meeting to process feedback from the Conference of Rulers. The panel formally asked the Attorney-General’s Chambers to refine all matters flagged during the meetings, for re-tabling before the committee within two weeks.
The proposed legislative changes were tabled for information during a pre-meeting session of the 273rd Conference of Rulers on Oct. 13, 2026. The bill was also discussed at the full Conference of Rulers meeting on Oct. 14 and 15, 2026.
Committee Stresses Constitutional Monarchy Principles
The parliamentary committee emphasized that all revisions must be examined properly, taking into account the views and considerations of the Conference of Rulers, in line with the principle of a constitutional monarchy and the supremacy of the Federal Constitution.
The committee issued a formal statement regarding the legislative process:
The PSSC remains committed to ensuring that the reform to separate the roles of the Attorney-General and the Public Prosecutor is carried out carefully, in an orderly and prudent manner, to strengthen the independence of the prosecution institution, enhance accountability and preserve confidence.
