Online travel agency Agoda is under fire after it was revealed that severance agreements offered to laid-off employees in Singapore included clauses preventing them from filing claims with government agencies. The move follows a restructuring that impacted customer support roles across multiple locations.
What Happened
On Wednesday, September 18, 2024, Agoda confirmed it had eliminated customer support positions in its Singapore, Hungary, and china offices, simultaneously creating new roles in other geographic locations. Approximately 50 employees in Singapore were affected by the restructuring according to CNA.
A copy of the severance agreement obtained by CNA contained provisions instructing employees to refrain from filing reports or initiating claims with Singaporean government bodies, including the Ministry of Manpower (MOM), the Tripartite Alliance for Dispute Management (TADM), and the tripartite Alliance for Fair and Progressive Employment Practices (TAFEP).Employees were also barred from seeking mediation.
The agreement stipulated that any breach of these terms woudl result in the revocation of severance entitlements. Furthermore, employees who had already received severance payments would be required to repay the full amount “on demand.”
Official Responses
The Ministry of Manpower (MOM) stated on Wednesday that it takes a “serious view” of such provisions and has initiated an investigation into the agreements.
The National Trades Union Congress (NTUC) and the Singapore Industrial and Service Employees’ Union (SISEU) jointly issued a strongly worded statement, describing Agoda’s instructions as “irresponsible and regrettable.”
agoda’s Statement
Agoda released a statement emphasizing its commitment to Singapore. The company stated, ”This restructuring and want to reaffirm our commitment to maintaining open dialog, upholding fair employment standards and supporting Singapore’s world-class workforce.”
Agoda also highlighted its continued investment in singapore, particularly in areas like artificial intelligence (AI), product development, and technology, and its intention to continue hiring for highly skilled positions.
The Controversy surrounding the Severance Agreements
The core of the controversy lies in the clauses within the severance agreements that appear to restrict employees’ rights to seek redress for potential unfair dismissal or other employment-related issues. Singaporean labor laws generally protect employees’ rights to file claims with MOM, TADM, and TAFEP. attempting to contractually waive these rights is viewed as potentially unenforceable and raises concerns about fairness and clarity.
Experts suggest that such clauses are likely intended to discourage employees from pursuing legal action,
