Aida Merlano’s Downfall: Supreme Court Upholds Corruption Conviction

In a new chapter of the case that has marked the recent political history of Colombia, the Supreme Court of Justice confirmed the sentence given to Aida Merlano Rebolledo, former congresswoman of the Democratic Center, for breaking the limits in her electoral campaign for the Senate in 2018.

The court’s decision makes final the sentence of five years and six months in prison, as well as a fine of 3,430 million pesos, issued in 2022.

This ruling comes after the annulment submitted by Merlano’s defense, which tried to overturn the conviction alleging various irregularities in the process. However, after a thorough analysis of the evidence presented at trial, the Court was of the opinion that there were not enough elements to modify the sentence.

The case against Aida Merlano began after a raid on her campaign headquarters in 2018, where authorities found clear evidence that her campaign finances exceeded the legal limits established by electoral law. The investigators discovered documents showing irregular payments, made through money transfers that were not properly reported to the authorities, which amounted to a clear breach of electoral regulations.

In addition to illegal payments, the case also revealed the participation of people close to Merlano, such as the Gerlein Echeverría brothers, who were involved in financing the campaign. According to the Court, the former congresswoman knew that the money received was more than the limits allowed by law and, therefore, acted deliberately to avoid the control of the electoral authorities.

The involvement of the Gerleins and other actors

One of the most controversial elements of this case is the involvement of members of the powerful Gerlein family, especially Julio Gerlein, an influential businessman and brother of the late former senator Roberto Gerlein.

Although he was initially investigated for his involvement in the illegal financing of Merlano’s campaign, this year the case was closed and he was cleared of any criminal responsibility.

On the other hand, former senator Arturo Char, also mentioned in the process, was arrested in 2021 for his alleged participation in a vote buying scheme involving Merlano.

However, after several delays and the introduction of a guardianship, Char was released without a sentence being imposed, which cast doubt on the abilities of justice to tackle high profile corruption cases.

As for Alex Char, Arturo’s brother and Merlano’s former lover, his name also appeared in the former congresswoman’s statements as part of an alleged network of electoral corruption.

Despite the notoriety of the case, Alex Char continues his political career as mayor of Barranquilla, completing his third term without major legal implications arising from the judicial process.

Clandestine and avoid control

One of the key factors that led the Court to confirm the conviction against Merlano was the “clandestity” of the transactions carried out to finance his campaign. The Court emphasized that the financial operations were deliberately designed to avoid the control of the authorities, reflecting a clear intention to evade the law.

For the high court, the fact that the funding figures were hidden and were not reported correctly to the competent authorities is a serious flaw that cannot be ignored. In this sense, the Court reaffirmed that Merlano acted with full knowledge that his campaign exceeded the limits established by electoral legislation.

The judgment of the Supreme Court of Justice not only confirms Merlano’s conviction, but also sends a clear message about the importance of respecting the rules in the electoral field. Although some of the actors involved, such as the Char brothers, managed to avoid convictions or were not prosecuted, the judicial decision reflects the Court’s firmness in pursuing corruption in Colombian politics.

With this confirmation, Aida Merlano must serve her prison sentence and face the imposed fine, which marks a milestone in the Colombian judicial system’s efforts to punish irregularities in electoral campaigns and guarantee a transparent democratic process.
