Potential Return of Malaysia’s Ministry of Law Signals Commitment to Justice and Regional Cooperation

A Renewed Focus on Legal Frameworks
Prime Minister Datuk Seri Anwar Ibrahim indicated on August 21, 2023, that his governance is seriously considering re-establishing a dedicated Ministry of Law. This move, announced at the Asean Law Summit, aims to strengthen Malaysia’s legal framework and, crucially, improve access to justice for all citizens. The potential ministry would represent a meaningful shift in the organization of legal affairs within the government.
Currently, legal matters fall under the purview of the minister in charge of law and institutional reform, Datuk Seri Azalina othman Said, who operates within the Prime Minister’s Department. A dedicated ministry would represent a return to a structure that existed before 1995, when the Ministry of Law was dissolved and it’s functions were absorbed into the Prime Minister’s Department through the creation of the Legal Affairs Division (BHEUU).
Boosting regional Influence and Coherence
The Prime Minister emphasized that a dedicated Ministry of Law isn’t solely about domestic improvements. It’s also about enhancing Malaysia’s role in regional legal cooperation. “this step will not only ensure greater coherence in our national legal ecosystem, but also enable Malaysia to engage more meaningfully with our regional partners in advancing the rule of law,” Anwar stated. This ambition aligns with Malaysia’s upcoming role as Asean Chair in 2025, where the themes of inclusivity and sustainability will be central.
Anwar highlighted the need for Asean to invest in areas like mutual legal assistance and strengthen dispute resolution mechanisms. He also pointed to emerging challenges requiring regional attention,including the governance of digital spaces and the regulation of artificial intelligence (AI).
Access to Justice: A Core Principle
A central tenet of the proposed legal reforms is a commitment to ensuring access to justice, particularly for vulnerable populations. Anwar underscored the critical importance of this, stating, “The issue of access is very critical to ensure justice for every single citizen. I have seen where the poor and marginalised have been largely ignored because there’s no access to the legal process.” This focus reflects a broader commitment to inclusivity, ensuring the law empowers and protects all citizens, rather than intimidating or excluding them.
Sustainability, as a guiding principle, means building legal institutions that are not only effective but also earn the public’s trust and endure over time.

The Prime Minister also highlighted Malaysia’s recent success in mediating tensions between Thailand and Cambodia,where Asean leaders facilitated a ceasefire. He described this as a “triumph of diplomacy,” demonstrating the power of dialog and principled cooperation in securing peace and stability within the region. This proactive role in regional conflict resolution underscores the importance of a strong and unified Asean, built on a foundation of the rule of law.
