A federal judge has temporarily barred the state of Arizona from enforcing its gambling laws against prediction market operators, effectively pausing a criminal wagering case filed by the state against the platform Kalshi.

U.S. District Judge Michael Liburdi issued the ruling on Friday, April 10, 2026. The decision resulted in the cancellation of a Monday arraignment hearing for Kalshi, which state prosecutors had alleged was operating an illegal gambling business.

The legal action follows a lawsuit filed by the Trump administration. The Commodity Futures Trading Commission (CFTC), a federal agency that regulates derivatives markets, intervened to challenge Arizona’s efforts to apply state gambling regulations to these platforms.

In the judge’s order, it was determined that the CFTC sufficiently demonstrated that event contracts fall under the definition of swaps as established by the Commodity Exchange Act. Arizona had previously targeted the company with criminal charges and cease-and-desist letters from state gambling regulators, arguing that such activity constituted unlicensed wagering.

The CFTC argued that Arizona’s attempts to prosecute Kalshi were an intrusion into the federal government’s exclusive power to regulate national swaps markets. This conflict centers on whether prediction markets should be classified as gambling operations subject to state laws or as financial instruments under federal oversight.

Arizona has contested this view in a legal request, asserting that federal law does not strip states of their traditional power over sports betting.

The dispute in Arizona is part of a larger federal effort to prevent states from regulating prediction markets. On April 2, 2026, the federal government filed lawsuits against three states—Arizona, Connecticut, and Illinois—challenging their respective attempts to regulate these operators.
