Ashley Malcolm, a 40-year-old burglar who headbutted and killed an 86-year-old Irish man as he tried to protect his 91-year-old wife in north London, has been jailed for 18 years. The attack occurred in the early hours of September 29, 2025, at the Hackney flat shared by retired plumber John Burke and his wife Peggy. Malcolm pleaded guilty to manslaughter, a separate burglary, and an attempted burglary, receiving an 18-year sentence with an additional five years on extended licence at the Old Bailey.
The Fatal Assault on John Burke
Judge Simon Mayo KC detailed during the televised sentencing that Malcolm embarked on a sustained course of criminal conduct during the night of September 28 and 29, 2025. Malcolm broke into the elderly couple’s home on Fountayne Road shortly before midnight, spending an hour and a half inside before leaving with a wheeled shopping trolley. He returned at 2:45 am after dumping the trolley’s contents elsewhere, spending another 20 minutes in the flat before leaving with a box under his arm.
During the prolonged intrusion, Malcolm headbutted Mr Burke. The blow fractured Mr Burke’s nose and caused intracranial bleeding. A carer visiting the flat later that morning found a broken window, a messy kitchen, and Mr Burke injured. He told her a 6-foot-tall man had beaten him around 11:00 pm. Mr Burke, who suffered from dementia and other conditions, waited seven hours for the carer to arrive because he was too afraid to leave his bedroom to call emergency services. Mrs Burke, who also has dementia, slept through the entire incident.

Hospital Fails to Spot Brain Injury Before Discharge
Following the assault, paramedics took Mr Burke to Homerton Hospital, where tests were performed before he was discharged at 2:35 pm that same day. The court heard that a locum radiologist failed to spot the broken nose and bleeding on the brain. The following morning, his son Sean found him unconscious on his bedroom floor. An ambulance rushed him back to hospital, where medical staff confirmed he sustained a devastating and irreversible brain injury alongside multiple bruises and the broken nose.
Within hours of targeting the Burke residence, Malcolm launched further attacks in the local area. At 6:25 am, he broke into a residential care home in Hackney, running toward a support worker while making loud groaning noises when confronted. Just after 6:55 am, he attempted to break into an apartment in nearby Stamford Hill using a screwdriver. A female resident challenged him while wearing only a towel after getting out of the shower. Her husband ran downstairs with a bicycle pump, which Malcolm seized and used to attack him.
Burke Family Describe Victim During Old Bailey Hearing
A large contingent of Mr Burke’s family attended the Old Bailey hearing, where victim impact statements were read by his two sons and a grandson. Sean Burke, who discovered his father unresponsive, described him as a quiet, hard-working, easy-going man who never had a bad word for anyone.

My dad did not deserve to die in such a way, he had earned the right to pass away from natural causes in his own silent way. Looking back now on the events of that night it angers me to think what this man had put my dad through. To think that this man felt that he had to attack my dad who was a vulnerable and frail elderly person who would never have been able to fight back. There was nothing of any value in the house as my parents did not have much but they had each other.

Grandson Reece Lambert told the court that he believed his grandfather was attacked as he tried to protect the woman he loved with everything he had left. Judge Mayo acknowledged the immeasurable loss felt by Mr Burke’s family before handing down the 18-year prison sentence.
