Auckland’s popular night markets are facing increased scrutiny after a former employee raised serious concerns about health and safety, leading to investigations by both the ‍commerce Commission and⁣ WorkSafe New Zealand. The issues prompted the individual’s departure from their⁢ role a few months ago.

The Commerce Commission confirmed it received two complaints regarding Auckland Night Markets in July and is‌ currently assessing them.Auckland Council also acknowledged receiving a single complaint about the markets operating on private property.​

WorkSafe’s ‌northern regional ​manager, Brad ⁤Duggan, stated the organization is “concerned to hear of the health and safety allegations” and is monitoring the ‍situation.

While the specifics of the⁤ concerns remain undisclosed, the allegations⁤ have prompted a closer look at the operational practices of the markets.

How Auckland Night Markets are Regulated

The regulatory landscape for Auckland night markets is complex. The majority operate on privately owned land,meaning they don’t require licensing from Auckland Council.”The majority of ‍Auckland night markets operate on private property and, as a result, are not licensed by Auckland Council,” a council spokesperson explained. “there ⁤are no market or street trading licences issued for⁢ activities on private land, ⁢such as mall⁢ carparks, even though resource consent conditions‍ may apply.”

However, this doesn’t meen they operate entirely without oversight. Resource consent conditions attached to the ⁣land use⁢ can still ⁢apply.

Silo Park night market is⁣ an exception.It operates⁢ under a tenancy lease with the Auckland Council and is required to adhere to specific conditions of use. This highlights the varying⁤ levels of regulation across diffrent market locations.
