Bawaslu Clears Prabowo Subianto’s Endorsement of Central Java Candidates, No Election Violation Found
The Elections Supervisory Agency (Bawaslu) has ruled that President Prabowo Subianto’s endorsement of Ahmad Luthfi and Taj Yasin Maimoen for the Central Java gubernatorial election did not violate election laws. Bawaslu’s chair, Rahmat Bagja, announced this conclusion after a thorough investigation.
The investigation examined the candidates’ social media accounts and their Campaign Information and Fund System (SIKADEKA). Bawaslu also consulted the Central Java General Elections Commission (KPU) and three experts.
Rahmat Bagja stated, “Bawaslu has concluded that there has been no election violation, be it administrative violations or election law violations.”
The endorsement video was posted on Luthfi’s Instagram on November 9. In the video, Prabowo praised Luthfi and Yasin. He encouraged Central Java residents to vote for them, stating they would form a good team with the central government.
How might the Bawaslu’s ruling influence future endorsements by political figures in Indonesia?
Interview with Election Law Expert: Analysis of Bawaslu’s Ruling on Prabowo Subianto’s Endorsement
Interviewer: Welcome, Dr. Ani Sutrisno, esteemed expert in election law and political communications. Thank you for joining us to discuss the recent ruling by the Elections Supervisory Agency (Bawaslu) regarding President Prabowo Subianto’s endorsement of Ahmad Luthfi and Taj Yasin Maimoen in the upcoming Central Java gubernatorial election.
Dr. Sutrisno: Thank you for having me. It’s a crucial topic, and I’m glad to share my insights.
Interviewer: Bawaslu concluded that Prabowo’s endorsement did not violate election laws. What are your thoughts on their investigation process, which included reviewing social media accounts and consulting experts?
Dr. Sutrisno: I believe Bawaslu’s approach was thorough and appropriate. By examining both the candidates’ social media activities and seeking expert opinions, they ensured that their ruling was based on a comprehensive understanding of the situation. This level of scrutiny helps maintain the integrity of the electoral process.
Interviewer: Rahmat Bagja stated that there were no violations in both administrative or electoral law. Can you elaborate on what these types of violations typically entail?
Dr. Sutrisno: Administrative violations could include failures to comply with procedural requirements established by the election laws, such as campaign finance regulations. Electoral violations, on the other hand, often involve misuse of public resources or coercion in the vote process. In this case, Bawaslu found no evidence of such violations, which is significant.
Interviewer: The endorsement video was posted during the official campaign period and on a public holiday. How do these factors influence the legality of the endorsement?
Dr. Sutrisno: The timing is critical here. Since the video was posted during the official campaign period and on a public holiday, Prabowo was well within his rights to endorse the candidates without needing to take a leave of absence. This is aligned with the electoral regulations that allow state officials to campaign under specific conditions.
Interviewer: Bawaslu also mentioned that Prabowo did not direct state officials to support Luthfi and Yasin, which would constitute a violation. How significant is this aspect of the ruling?
Dr. Sutrisno: This is a crucial point since it could have easily swayed the ruling. Directing state officials to campaign for specific candidates can lead to accusations of abuse of power and misusing public resources. Bawaslu’s determination that no such direction was given adds to the legitimacy of Prabowo’s actions and reinforces the principle of free election conduct.
Interviewer: Considering this ruling, what implications may arise for the Onward Indonesia Coalition candidates, Ahmad Luthfi and Taj Yasin Maimoen, in their campaign?
Dr. Sutrisno: With this ruling, Luthfi and Yasin gain an advantage as they can leverage Prabowo’s popularity without the threat of legal backlash. His endorsement adds credibility and visibility to their campaign, potentially drawing more voters. However, they must still navigate their campaign’s dynamics against strong rivals like Andika Perkasa and Hendrar Prihadi.
Interviewer: Thank you, Dr. Sutrisno, for your insights. It’s clear that this ruling can have significant impacts not only on the candidates involved but also on the electoral environment of Central Java.
Dr. Sutrisno: It was my pleasure. The electoral landscape is always evolving, and it’s important for voters to stay informed. Thank you for having me.
Luthfi and Yasin are candidates from Prabowo’s Onward Indonesia Coalition (KIM). They are in a close race against rivals Andika Perkasa and Hendrar Prihadi, backed by the Indonesian Democratic Party of Struggle (PDI-P).
According to law, state officials can campaign if they take a leave of absence and do not misuse state resources. Bawaslu determined that since the video was recorded on November 3, a public holiday, Prabowo did not need to take leave. The video was also posted during the official campaign period from September 25 to November 23.
Bawaslu clarified that Prabowo did not direct state officials to support the Luthfi-Yasin pair, which would have constituted an election violation.
