LEUVEN, Belgium (AP) —​ A medical student in Leuven, Belgium, has been found guilty ‌of​ rape but will not face any immediate punishment, according to Belgian media reports. The⁢ ruling has sparked ⁢debate about the intersection of justice, potential, and accountability.

Judge Cites Youth, Potential in‌ Controversial Ruling

The judge acknowledged ⁢that the 24-year-old student “exceeded the permissible,” but⁤ cited his⁢ youth, clean criminal record, and status as ⁢a ⁤”talented and​ committed person both in private ‌and‍ professionally” as reasons for the suspended⁤ sentence. The judge opted to declare him guilty without imposing a penalty.

Victim’s‍ Outlook

According to VRT, the victim expressed⁢ satisfaction with the ​court’s decision. Her lawyer stated that the moast critically ⁢important aspect for the victim was‍ the acknowledgment that a rape occured and that the ‌perpetrator understood his guilt.

The incident occurred in the ⁤fall of 2023 at a halloween party in a student café. The victim’s lawyer stated ⁣that her client suddenly felt unwell, lost her balance, and required⁤ assistance to avoid falling.

Conflicting Accounts

The student claimed the victim initiated contact and ⁤provided ⁢consent. He ​stated that⁢ he walked her to his residence after⁢ she​ requested⁤ directions to a late-night convenience store, and that she consented to the sexual act.

Judge Rejects Consent​ Claim

The judge rejected the⁢ student’s version‍ of events,⁣ stating that he “abused ‍her drunkenness” and that she was in ⁢no condition to consent to‍ sexual activity.

Sentencing and Restitution

Prosecutors had sought a three-year prison sentence. The student argued that a criminal record would severely hinder his future career prospects⁢ in medicine, emphasizing his current clean record.

While avoiding prison time, the ‍student is required to pay 3,500​ euros in ⁤compensation to the​ victim. Furthermore, he will face punishment⁤ for the⁤ rape should he commit any further offenses.
