Music executive Jonathan Hay is facing a defamation countersuit from Sean ”Diddy” Combs’ former associate, Andre Wallace, stemming from allegations made against Combs. Wallace alleges that Hay fabricated a story about being sexually assaulted by Combs to explain why Hay’s film, “Big Poppa,” flopped in August 2020. Wallace claims Hay was “irate” at this decision adn later created the false narrative.
“The statements constitute defamation,” writes Wallace’s attorney, jeremiah Reynolds of Eisner LLP. “As a direct and proximate result,Wallace has suffered general and special damages, including loss of professional opportunities, humiliation and mental anguish.”
wallace’s defamation claims are specifically focused on a YouTube video published in October, where Hay detailed his accusations. This is because legal filings are generally protected from slander liability under the principle of litigation privilege. The lawsuit does not target Hay’s initial sexual assault lawsuit itself.
Hay revealed his identity in the October video, titled “jonathan Hay Details EXACTLY What Happen When Diddy A$$AULTED Him, Forced to S*CK D*CK & VlOLATED!” While Hay’s assault lawsuit was initially filed anonymously.
Hay declined to comment on the countersuit when contacted by Billboard on Friday (Nov. 14), but confirmed he has filed a police report in addition to the ongoing civil lawsuit against combs and Wallace.
Representatives for Combs did not promptly respond to a request for comment. Combs is currently serving a prison sentence for arranging drug-fueled sex marathons involving his girlfriends and male escorts, though he was acquitted of more serious sex-trafficking and racketeering charges following a high-profile trial this summer.
