French Court Ruling Offers Hope for Brexit Voting Rights
A recent French court decision is raising hopes for British citizens in France who lost their voting rights following Brexit. The ruling centers on restoring voting rights to certain U.K. nationals who where previously registered to vote in France.
Before Brexit,British residents in France could participate in local and European elections. however, French law reserves parliamentary and presidential voting rights for French citizens. Brexit eliminated these rights unless a Briton undertakes the naturalization process, wich many find lengthy and costly.
The ruling stems from a case brought by Alice Bouilliez,a retired British civil servant residing in France for over 30 years. The Auch tribunal in southwestern France ruled that Bouilliez should be reinstated on the electoral roll after her name was removed post-Brexit in 2020.
“I am extremely happy about the result… I have won the right to vote only in the EU elections. The rest is for later I hope,” Bouilliez said.
The court’s decision is narrow. It applies only to European elections, not local French elections, and only to Britons who lived in France before Brexit and were already registered to vote. Bouilliez previously lost a similar case before the European Court of Justice in 2022.
Several Britons have filed similar cases with the European court regarding pre-Brexit rights, all of which have been unsuccessful. The Auch court is a lower-level tribunal, and its ruling could be overturned on appeal. The Conseil Constitutionnel has the final say on election matters in france.
Some countries, including Spain, Portugal, Denmark, Poland, and Luxembourg, have reciprocal voting rights agreements. France and the U.K. do not have such a treaty.
What’s next
A treaty between France and the U.K. could grant voting rights to all British citizens in France, including those who moved after Brexit. However, no negotiations are underway.
