The 6-1 decision rejects claims from thousands of patients who alleged the company was negligent by delaying the release of a safer HIV drug to protect the sales of an older product, according to reporting from STAT.

The ruling reverses a state appeals court decision from two years prior. That earlier ruling had suggested Gilead could be held legally responsible for the health outcomes of patients who used an older medication while a safer alternative remained in development. The Supreme Court’s reversal removes that liability, according to STAT.

Patient Allegations of Kidney Injury and Bone Loss

The legal challenge originated from more than 24,000 individuals who filed lawsuits in both state and federal courts. These plaintiffs claimed they suffered unnecessary kidney injury and bone loss as a result of using an older HIV medication produced by Gilead, according to STAT.

The plaintiffs argued that Gilead cynically managed its product pipeline. They maintained that the company intentionally slow-walked the development of a safer HIV medicine to continue selling the older version, which they alleged resulted in avoidable patient harm, according to STAT.
