CCR Judge Appointed by Nicușor Dan Accused of Conflict of Interest
A document issued on Thursday by the Trade registry, at the request of lawyer Silvia Uscov, shows that CCR judge Dacian Dragoș Cosmin, appointed last summer by Romanian President Nicușor Dan, holds the position of administrator at a joint-stock company in cluj-Napoca and is the representative of a foundation that holds the status of associate in the respective company. CCR Judge Dacian Dragoș Still Appears as Administrator of a Company in Cluj-Napoca
In a post published on Thursday on Facebook, lawyer Uscov presents the ONRC documents attesting that the CCR magistrate has the status of administrator within a company in Cluj-Napoca.
“Dacian Dragoș is currently incompatible to exercise the function of CCR judge. Article 144 of the Constitution states that the position of judge of the Constitutional Court is incompatible wiht any other public or private function, with the exception of teaching positions in higher legal education. Mr. Judge Dacian Dragoș holds the position of administrator in his own name and is the representative of a foundation that holds the status of associate in Radoncontrol S.A. The National Integrity Agency (ANI) must conduct investigations immediately,” Silvia Uscov wrote on her social media page.
The documents presented by the lawyer were issued by the National Office of the Trade Registry (ONRC) at her request on Thursday, january 15. According to these, Dacian Dragoș was appointed administrator within Radoncontrol in April 2022, the mandate expiring on April 26, 2026. Surse din cadrul ONRC au precizat pentru HotNews că operarea unor schimbări în cadrul unei societăți se acutalizează în termen de câteva zile.
Potrivit legii, în cazul unei societăți pe acțiuni, adunarea generală a acționarilor ia act de demisie și comunică informația ONRC. Dacă nu se întâmplă acest lucru,demisia nu are efect.
Radoncontrol este o companie înființată la Cluj, în 2020, având ca obiect „activități de testare și analize tehnice”.
