A 96.5 Million Dollar Settlement Fund Targets Price Fixing
The distribution plan draws from settlements totaling approximately $96.5 million. Those agreements were reached with drug manufacturers Glenmark, Lannett, Bausch, Apotex, Heritage, and Heritage’s parent company, Emcure. The coalition’s legal actions trace back to a series of antitrust cases launched in 2016. The initial complaint named Heritage, 17 other corporate defendants, two individuals, and 15 generic drugs. A second complaint followed in 2019 against Teva Pharmaceuticals alongside 21 other large generic manufacturers and 16 senior executives.
A third complaint focuses on 80 topical generic drugs accounting for billions of dollars in U.S. sales, naming 26 corporate defendants and 10 individuals. A fourth complaint filed earlier this year alleges Novartis AG, Sandoz Group AG, and Sandoz AG are liable for Sandoz’s conduct and fraudulent asset transfers. The state investigations relied on millions of documents, extensive phone record databases, and evidence from several cooperating witnesses, including seven cooperating pharmaceutical executives. State officials stated that defendants utilized terms like fair share, playing nice in the sandbox, and responsible competitor to enforce an ingrained culture of collusion that unlawfully discouraged market competition.

The multistate coalition spans nearly nationwide participation, including Alaska, California, New York, Wyoming, Michigan, New Jersey, and dozens of other jurisdictions working in coordination to distribute the recovered capital directly back to impacted buyers.
