The Cundinamarca Administrative Court made a key decision that could change a diplomat’s career Andrés Camilo Hernández Ramírez, current Colombian consul in Mexico. The court temporarily suspended his appointment and admitted the lawsuit filed by the Union of Diplomatic and Consular Careers Officers of Colombia (UNIDIPLO), which questions Hernández’s appointment to that position.

The precautionary measure was published this November 5, in response to a request from Unidiplo, which considers that the appointment of Hernández goes against the legal regulations that govern appointments in the diplomatic service of Colombia. According to the lawsuit, The selection process did not comply with the requirements established by law for the appointment of officers in diplomatic posts.

The decision of the Administrative Court is based on the judgment issued by the Council of State on May 14 this year, when the annulment of the previous appointment of Andrés Camilo Hernández Ramírez was declared. Despite this revocation, the Ministry of Foreign Affairs, which was in charge of the Chancellor, proceeded to re-appoint him to the same position on August 2, 2024, through decree 0984.

The Court considered that this administrative act, which annulled the previous judgment, ignored the rules established by the jurisprudence of the Council of State, which created clear nonsense in the management of appointments by the Chancellors. The court highlighted that, being aware of the previously announced annulment, the Ministry of Foreign Affairs had acted irregularly by proceeding with the new appointment of Hernández without sufficient justification that respected legal procedures.

Furthermore, the court emphasized that the post should, by law, have been filled by a diplomatic and consular career officer, and not by a person who, according to the legal proceedings, did not meet the requirements established for the job. This argument was key in the decision to suspend the appointment and lead to the legal proceedings.

Unidiplo Support

The Union of Diplomatic and Consular Career Officers of Colombia (Unidiplo) celebrated the judicial decision, describing it as a positive step towards the correct application of the regulations that govern the diplomatic career. In an official statement, the organization expressed its satisfaction with the precautionary measure, while urging the Ministry of Foreign Affairs to do adequate follow-up to ensure compliance with the court order.

“We approve the decision of the Administrative Court of Cundinamarca to order the precautionary measure of suspending the temporary consul in Mexico, Andrés Camilo Hernández Ramírez. We ask the Ministry of Foreign Affairs to follow up in order to comply with this judicial decision to the letter, ” he said. the Unidiplo.

One of the points most criticized by the court was the actions of the Ministry of Foreign Affairs in ignoring the previous decisions of the Council of State. The magistrates considered that Decree 0984, which once again validated Hernández’s appointment, showed complete ignorance of the court orders issued, which prompted the legal action and the subsequent intervention of the Administrative Court.

The court also noted that the insistence on the appointment of Hernández, despite the previous annulment and the legal precedents that favored other diplomatic career officers, shows a pattern of disregarding judicial provisions, which creates an environment of legal uncertainty in the management of the Chancel.

An ongoing process

Although the temporary suspension of Hernández from his post as consul in Mexico has been ordered, the court explained that the decision does not imply a final prejudice on the case. The precautionary measure will remain in place until all the evidence has been resolved and a final judgment is issued.

The court recalled that the Ministry of Foreign Affairs has an obligation to respect the processes established by law and to guarantee that diplomatic appointments are made in accordance with the principles of change and the availability of diplomatic career officers.
