The dispute centers⁤ on the university’s online store selling merchandise ⁤featuring the name “Columbia” without the company’s distinctive logos, leading ‌to what the sportswear giant claims is irreparable harm to its ‍brand.

The allegations: A Case of Confusingly‍ Similar ​branding

Columbia Sportswear, which boasts ⁢over 800 retail locations worldwide and a strong online presence, claims that Columbia‌ University violated ⁣an agreement by selling garments ‌that ‍bore only the university’s name. the lawsuit, filed by the portland-based company, highlights several items sold on the university’s⁢ online store that lacked​ the familiar Columbia Sportswear branding.

A key point of contention, according to​ the suit, is the ​use of a ​radiant⁢ blue color on some of the university’s merchandise. ⁤Columbia ⁤Sportswear alleges this shade is “confusingly ‌similar”‍ to the signature blue long associated ⁣with​ its own brand. The lawsuit includes⁣ photographic evidence of⁢ these university items,which reportedly display only the word “Columbia.”

“The likelihood ​of deception, confusion, and mistake engendered ‍by the university’s misappropriation‍ and misuse‌ of the Columbia name ⁣is causing irreparable harm‌ to the ⁤brand and goodwill symbolized by ​Columbia Sportswear’s registered mark Columbia and the ​reputation⁢ for quality it‍ embodies,” the lawsuit⁢ states.

A Troubled⁢ Financial‌ Landscape for the University

This legal action comes at a particularly sensitive time for ​Columbia ⁣University, ‌which ⁤has recently⁢ been embroiled in ⁣discussions⁢ regarding potential significant losses in federal funding. The Ivy League ​institution ‍recently reached a substantial agreement with the Trump ‍administration, committing to pay over $220 million to ‌the federal government. This payment ‌is intended to reinstate federal research funds that were previously canceled, a ‌move⁢ reportedly made in the context of addressing antisemitism on campus. The university has confirmed it will pay $200 million‍ over a three-year period as part of this settlement.

Columbia Sportswear’s Demands

Columbia Sportswear is​ seeking a ‍court order to halt all​ sales of merchandise⁢ that allegedly violates their agreement. Furthermore,the⁤ company is⁢ requesting the recall ⁣of any ⁤infringing products already sold and the⁣ donation of any​ remaining merchandise ‍to charitable organizations. Beyond these actions, Columbia Sportswear ​is also seeking damages, specifically requesting an amount equivalent to three times the actual damages determined by a jury.
