The Allegations
According to Garda Sergeant Davis’s statement to the court,the complainant alleges that on October 27,2023,at approximately 4:00 PM,while driving in Cork,she was approached by her ex-partner. She claims he began beeping his horn to get her attention, then drove alongside her vehicle and verbally abused her, calling her names including “dirty rat” and “whore.”
The alleged harassment escalated after the roadside encounter. Sergeant Davis stated the complainant later received over 200 messages via Facebook and Instagram on October 28, 2023. These messages reportedly contained further abusive language, including derogatory terms like “tramp” and “whore,” suggestions that she should take her own life, and a video of the accused allegedly engaging in masturbation.
Defense Argument and Bail Conditions
Defense solicitor Shane Collins-Daly, representing the accused, argued in court that his client was intoxicated at the time of sending the messages and video. He attributed the behavior to the accused being upset after seeing his ex-partner with another individual during their chance encounter. Mr. Collins-Daly maintained that while the messages were ”clearly abusive, insulting and obscene,” they did not contain direct threats to the complainant.
The defendant himself stated he “overreacted” after seeing the other person in the car and immediately began drinking.He described feeling “a little bad” in his head.
Judge Mary Dorgan granted bail with strict conditions. These conditions include a complete ban on any contact, direct or indirect, with the complainant – a condition mirroring an existing protection order. The bail is set at a bond of €750, requiring a €500 cash deposit and an independent surety of €500 with a €250 cash deposit.
Next Steps and Court Date
The case has been adjourned and is scheduled to be heard again on November 5, 2023, at Cork District Court.the defendant is expected to appear on that date.
