Crown prosecutor Matthew Harper told a 12-person jury at the Downing Centre District Court on Monday that the alleged victim and his girlfriend dined at The Beresford Hotel in Surry Hills around 7:30pm on May 31, where the complainant consumed approximately four beers.
They then moved to Worldwide at about 9:45pm, where Massa, a stranger to them, was also present.
Harper stated the jury will view CCTV footage showing an initial interaction around 12:45am, where the complainant kissed Massa’s hand and invited him to join them in the smoking area.
There, it is alleged Massa flirted with the complainant, who “politely declined” his advances, suggesting others in the venue might be interested.
The prosecution alleges that while they were talking,Massa reached around and down the back of the man’s underwear and committed sexual intercourse without consent. “It is the Crown’s case this occurred suddenly and unexpectedly and caused the complainant pain,” Harper said.
Massa is further accused of staring at the complainant while performing an act too graphic to detail.
Harper anticipates the complainant will testify the assault occurred two or three times, though CCTV footage appears to show it happening twice. the alleged victim had four to five beers at the venue, the court heard.

As they left the venue, the man allegedly told his girlfriend about the sexual assault. The following morning, he allegedly woke in pain and discussed the assault further with his partner.
Later that day, Harper said the jury will hear, he went to hospital, where he underwent an examination and DNA swabs were taken.
