Sean “Diddy” Combs has withdrawn his appeal for bail, a notable growth following his recent conviction on prostitution-related charges. The music mogul, who has been in custody since his September arrest, saw his legal team make a strategic shift in their approach to securing his release.
Legal Setback and Defense Strategy
Combs, 55, was controversially cleared of racketeering and sex trafficking charges earlier this month. However,he was convicted on two counts of prostitution-related offenses, specifically violating the Mann Act by transporting male sex workers across state lines. His defense team had argued that in similar cases, defendants were typically released pending sentencing.
In a new filing, Combs’ attorneys have attempted to reframe his relationships with ex-girlfriends Casandra “Cassie” Ventura and an accuser identified as “Jane.” Both women had testified about alleged orgies, dubbed “freak-offs,” and made accusations of violent behavior. The defense now claims that Combs’ relationships with these women were consensual and open, akin to a “swinging” lifestyle.
“In the the lifestyle he and other adults voluntarily chose, Mr.Combs would be called a swinger,” the motion states, asserting that “Sean Combs should not be in jail for this conduct.”
Downplaying Allegations and citing Rehabilitation
Combs’ legal team maintains that he is neither a flight risk nor a danger to the community or any specific individuals. The motion also seeks to minimize the impact of domestic violence allegations against him. This comes despite security footage showing Combs kicking and dragging Ventura in a Los Angeles hotel. The accuser “Jane” had also leveled accusations of forced sex, physical violence, and abuse.
While acknowledging a “history of domestic violence” in earlier proceedings, the defense filing claims Combs struck ”Jane” twice in June 2024 only after she “provoked” him. The motion also highlights that Combs had enrolled in a domestic violence program prior to his arrest last year.
“As we said in court this jury gave [Combs] his life back, and he will not squander his second chance at life, nor would he do anything to further jeopardize his seven children not having a father, and four of his children not having a parent at all,” the defense team stated in the motion, referencing the four children Combs shares with the late Kim Porter.
Proposed Bail Package and Future Conditions
The proposed bail package outlined by Combs’ attorneys included a $50 million bond secured by his Miami home. If released, his travel would be restricted to specific locations in Florida and New York for attorney meetings, as well as the necessary airports for travel between these destinations.
To further ensure his release, Combs’ legal team expressed openness to additional court-imposed conditions, such as house arrest, mental health treatment, and substance abuse treatment, should the court deem them necessary.
