Construction Firm Sues Glazing Giants Over €6.8 Million Defects at Dublin’s Exo Building

Bennett (Construction) Ltd. has initiated legal action against Spanish firm Tvitec System Glass SL and it’s Irish subsidiary, Technical Envelope Facades (TEF) Ltd., alleging meaningful defects in glass installation at Dublin’s prominent exo Building, with repair costs estimated at €6.8 million.
Legal Battle Unfolds in Commercial Court
The dispute,heard in the Commercial Court,centers on claims of substandard workmanship and defective glazing supplied by TEF. Bennett (Construction) Ltd., based in Mullingar, Co. Westmeath, contends that the installation of the glazing was of poor quality, leading to considerable leaking issues.
Defendants Deny Allegations
Tvitec System Glass SL and TEF Ltd., formerly Tvitec System Ireland Ltd., with a registered address in Tallaght, Dublin, have formally denied all claims made by Bennett (Construction) Ltd.
Case Rejected from Fast-Track Court
an application to have the case admitted to the fast-track Commercial Court was refused by Mr. Justice mark Sanfey.the decision was based on a finding of ”culpable delay” by bennett in initiating the proceedings. Consequently, the case will now proceed through the standard High Court list.
Timeline of Events and Financial Disputes
The legal proceedings stem from an agreement entered into in March 2018 between Bennett and TEF for the supply and installation of glazing. TEF also entered into a collateral warranty with The Platform ICAV (formerly Davy Platform ICAV), the project’s beneficiary, with the Spanish parent company, tvitec System Glass SL, providing a guarantee for TEF’s obligations. The benefits of both the collateral warranty and the guarantee were assigned to Bennett in August 2024.
According to Paul Bruton, managing director of Bennett, TEF commenced works in January 2018. Throughout the project, TEF reportedly experienced ongoing cash flow issues.A critical juncture was reached in January 2022, when TEF failed to return to the site following the Christmas break, despite significant delays already plaguing the project.
Financial Demands and Contractual Standoff
A subsequent meeting revealed TEF’s financial difficulties and that the works were proving unprofitable. TEF stated they would only resume work upon receipt of an additional €850,000. Bennett claims to have already paid €10.1 million to TEF,with a further €625,000 paid “under duress” to encourage TEF’s return to the site. Despite returning, TEF allegedly failed to complete the works and subsequently abandoned the site once more.
Conciliation Attempts Fail
Under the terms of the collateral warranty, the dispute was eligible for conciliation. Though, TEF refused to nominate a conciliator and rejected Bennett’s nominated conciliator, leading to the conciliator’s resignation in December 2024.
Remedial Works and Claim Value
In the interim, Bennett has undertaken extensive remedial works through various subcontractors. Mr.Bruton stated that the total sum being claimed against the defendants for the cost of these remediation efforts amounts to approximately €7.4 million.
