Rodrigo Duterte’s defense team is demanding the immediate disqualification of International Criminal court (ICC) Prosecutor Karim Khan, alleging a severe conflict of interest that compromises the fairness of the proceedings against the former Philippine president. The call for disqualification centers on Khan’s prior legal work representing victims alleging extrajudicial killings linked to Duterte’s controversial “war on drugs.”
Allegations of Prior Portrayal and Bias
Duterte is currently detained in The Hague, Netherlands, facing charges of crimes against humanity related to the thousands of deaths that occurred during his administration’s aggressive anti-drug campaign. His lead counsel,Nicholas Kaufman,argues that Khan’s previous representation of victims directly clashes with his current role as prosecutor.
“When assuming the role of Chief Prosecutor in June 2021, and proceeding to oversee the investigation in the Philippines, Mr. Khan took on the statutory obligation of actively seeking exculpatory evidence,” Kaufman stated. “Yet such exculpatory evidence could, by its very nature, cast doubt on the testimony provided by the same people whose interests he had been charged to protect.”
The defense team asserts that Khan’s past advocacy creates an insurmountable bias, preventing him from impartially investigating and prosecuting the case. they emphasize that a prosecutor is obligated to seek evidence that both incriminates and exonerates, and that Khan’s prior commitment to victims’ interests fundamentally undermines this duty. The team insists Khan must be disqualified “immediately and without delay” to ensure a just and unbiased legal process.
Background: The Philippines Drug War and ICC Investigation
Duterte’s “war on drugs,” launched in 2016, aimed to drastically reduce drug trafficking and addiction in the Philippines. While the campaign demonstrably lowered drug proliferation, it was together plagued by widespread allegations of extrajudicial killings (EJKs) carried out by police and vigilante groups.
Official government figures reported 6,252 deaths attributed to EJKs by 2022. however, human rights organizations and academic researchers estimate the actual death toll to be substantially higher, ranging from 12,000 to 30,000 civilians killed in “antidrug operations.” These discrepancies and the nature of the killings prompted international scrutiny and ultimately led to the ICC investigation.
