FBI Director Kash Patel has publicly denied and threatened legal action against a report by The Atlantic alleging excessive drinking, unexplained absences, and erratic behavior during his tenure as bureau chief, claims he dismissed as a “legal layup” and vowed to challenge in court.

The article, published on April 18, 2026, cites more than two dozen unnamed current and former FBI officials who describe episodes of “freak-outs,” obvious intoxication at private clubs in Washington and Las Vegas, and instances where Patel was unreachable by his security detail, including one occasion when agents reportedly requested breaching equipment to access him behind locked doors.

Officials said these incidents raised concerns about leadership stability and public safety, particularly amid ongoing U.S. Military operations against Iran, with one official telling The Atlantic that doubts about Patel’s ability to respond to a domestic terrorist attack “keep me up at night.”

Patel responded on X (formerly Twitter), directing criticism at The Atlantic and its author, writing: “See you and your entire entourage of false reporting in court,” and later adding: “Memo to the fake news – the only time I’ll ever actually be concerned about the hit piece lies you write about me will be when you stop.” He framed the allegations as motivation, stating: “Keep talking, it means I’m doing exactly what I should be doing. And no amount of BS you write will ever deter this FBI from making America safe again and taking down the criminals you love.”

The White House defended Patel through spokesperson Karoline Leavitt, who emphasized declining crime rates and high-profile arrests under his leadership, calling him “a critical player on the Administration’s law and order team.”

The allegations add to a pattern of scrutiny surrounding Patel’s conduct. In September 2025, he faced bipartisan criticism for prematurely announcing a suspect in custody in the killing of right-wing commentator Charlie Kirk, a move Senator Dick Durbin (D-IL) criticized as violating basic investigative protocol. Patel said he had “no regrets,” citing a desire for transparency.

In December 2025, Democrats on the House Judiciary Committee demanded reimbursement after reports surfaced that Patel used government aircraft for a “date night” with his girlfriend, a country singer, to attend her performance in Pennsylvania, along with trips to Texas and Scotland. He dismissed the claims as “baseless rumors.”

Most recently, in February 2026, Patel drew attention for attending the Milan-Cortina Olympics to watch the U.S. Men’s hockey team win gold, where videos showed him chugging a beer, wearing a medal, and celebrating with the team. An FBI spokesperson maintained the trip was planned months in advance and not personal.

The Department of Justice ethics handbook prohibits habitual intoxication, and if substantiated, the allegations in The Atlantic report could constitute a violation of federal standards. As of now, no formal investigation has been announced, and Patel remains in office amid ongoing scrutiny of his leadership.
