A Fianna Fáil TD has raised concerns with the Housing Minister over the unintended consequences of new rental legislation on tenants seeking to replace flatmates, as the Residential Tenancies Board (RTB) weighs in on the growing stand-off between landlords and tenants over “flatmate swaps.”

The TD, whose name was not disclosed in the available reports, wrote directly to Minister James Browne expressing concern that recent changes to rental rules are creating inadvertent barriers for tenants attempting to swap flatmates in shared accommodation. The concerns were raised amid increasing reports of difficulties faced by renters in house shares when one tenant departs and another seeks to take their place under the revised regulatory framework.

Under the Residential Tenancies Act 2004 (as amended), a landlord can only grant one lease or tenancy agreement for a dwelling, which is creating complications when tenants attempt to replace flatmates without terminating and re-establishing the entire tenancy.

RTB spokesperson

The Residential Tenancies Board explained that the current legal structure permits only a single tenancy agreement per property, meaning that any change in occupancy — such as replacing one flatmate with another — requires either a formal amendment to the existing lease or the creation of a new tenancy agreement, both of which may trigger additional procedural and financial requirements under the updated rental legislation.

Minister James Browne, who oversees housing policy as part of his role in the Department of Housing, Local Government and Heritage, has been contacted directly by the Fianna Fáil TD regarding these issues. The TD warned that the unintended consequences of the new rules could disproportionately affect tenants in shared housing arrangements, particularly in urban areas where house shares are common due to high rental costs.

The concerns highlight a growing tension between the objectives of recent rental reforms — aimed at increasing security and affordability for tenants — and their practical impact on flexible living arrangements common among students, young professionals, and low-to-moderate income renters.

While the specific provisions of the new rental legislation were not detailed in the available sources, the RTB’s interpretation suggests that the legislation reinforces or clarifies restrictions on multiple tenancies within a single dwelling, thereby affecting how flatmate changes are processed.

The Journal reported that the issue has prompted discussion among housing advocates, landlord representatives, and tenant groups, with some arguing that the rules need clarification to accommodate legitimate tenant turnover without penalizing either landlords or incoming tenants through increased administrative burdens or costs.

As of the date of reporting, no official response from the Minister’s office or the RTB had been published addressing the TD’s specific concerns, though the RTB had previously issued guidance on the matter in response to ongoing queries from stakeholders in the rental sector.
