A court in São Paulo has granted a request from the children of former Brazilian President Fernando Henrique Cardoso to place him under legal guardianship, known as interdição, due to his health condition.
The decision, issued by the Tribunal de Justiça de São Paulo (TJSP), follows reports that the former president is suffering from Alzheimer’s disease. As part of the court’s ruling, one of his sons has been appointed as a provisional curator to manage his affairs.
Legal Guardianship and Appointment
The legal process of interdição is used when an individual is deemed unable to express their will or manage their own personal and financial interests. In this case, the TJSP accepted the petition filed by the children of Fernando Henrique Cardoso, citing the necessity of legal protection for the former head of state.

By appointing a provisional curator, the court ensures that the former president’s needs are met and his legal and financial interests are protected while the full legal process continues. This measure allows the designated family member to make decisions on his behalf.
Health Context
The court’s decision is tied to the former president’s diagnosis of Alzheimer’s disease. This progressive neurological disorder affects cognitive functions, memory, and the ability to perform daily tasks, eventually leading to a state where the patient can no longer make autonomous legal or medical decisions.
The request for interdição was initiated by his children to ensure that the former president receives the necessary care and that his legal rights are safeguarded as the disease progresses.
