Games of Chance & Amparos in Casinos

Mexico’s ‌supreme ‌Court Declines too Clarify Casino Regulations

MEXICO ⁤CITY (AP) — The Supreme Court of Justice of the Nation (SCJN) has turned down a request from the Ministry of the Interior (segob) to provide further clarification on the legal standing of⁤ casinos in ⁣Mexico. This decision ‌comes ⁤as several casino ⁢companies have‍ successfully ⁤used legal⁤ challenges, known as “Amparos,” to continue offering games involving cards and roulette.

Court Refuses‍ to Reassume Jurisdiction

During a private session on March‌ 26, the First Chamber of the Court rejected Segob’s attempt to regain control over six Amparos under ⁢review. These ‌Amparos perhaps challenged reforms made by former‌ President Andrés Manuel López Obrador to the Regulation of the Law and Sortions Law, wich were implemented‌ in November 2023.

The cases in question involve companies such as Hot Group, which operates ‌17 casinos under‌ the Winpot and Crown‌ Supreme brands, and Zitro Games, a slot machine manufacturer. The Second ‍and Tenth Collegiate Courts in administrative matters will now ⁢handle these cases.

Ministry’s Legitimacy Questioned

The court steadfast that Segob lacked the necessary standing to request the Supreme‌ Court’s intervention. ‍For the court⁢ to consider the request,⁢ it would have needed to originate from one of⁤ the ministers themselves.

Ambiguities in Regulations Lead⁣ to Legal Challenges

Companies, including sports shows of the West, festive events in Mexico, and attractions and emotions Vallarta, previously ⁤won unappealable Amparos against the regulation in the Tenth‍ Second Court Collegiate. These Amparos allow them ‌to offer card games, roulette, and dice.

López Obrador’s reform aimed to tighten restrictions on casinos and prohibit the‍ installation of new ⁣slot machines. However, the⁤ reform has inadvertently provided ‍casino operators ⁢with legal grounds to challenge long-standing ambiguities ⁤within the existing regulations.

Judges Rule Reforms Unconstitutional

Three federal judges have⁢ ruled the entire reform unconstitutional. They have also stated that ‍casinos are permitted to ‍offer card games, dice, and roulette as ⁢the Federal⁣ Law of games and Draws⁣ (LFJS), which ⁤has⁣ not been updated by Congress as 1947, allows⁤ it.

One of these judges,Gabriel Regis,is ⁣now⁢ a candidate for Court Minister.

Games of Chance vs. Skill

According‌ to court rulings, dice ⁢are explicitly authorized by the LFJS. Other games are considered legal⁣ as their outcomes depend more on chance than on the participant’s skill, making them similar to a lottery.

Both the judges and⁣ the collegiate court have agreed that dice, card games, and roulette are legal, despite ⁢the López Obrador administration’s regulatory reform attempting to exclude them from ‌being ⁢considered “raffles.”

Slot Machine Prohibition Also Overturned

Judges have ‌also ruled against ‌the prohibition of installing new slot machines, citing a 2016 Court endorsement ‍based on the argument that they are games of ⁤chance similar to a lottery.
