German Court Fines Curator Edwin Nasr for Pro-Hamas Instagram Posts

A German court found Edwin Nasr, a Berlin-based curator and writer, guilty of “approval of crimes” related to their Instagram posts about Israel Sparks International Concern and US Army Response"</strong></p>”>Hamas‘s attack during a dance festival in Israel on October 7. The court imposed a €1,000 (~$1,058) fine on Nasr, who identifies with they/them pronouns. On October 8, 2023, Nasr shared three Instagram stories. The first post included a historical illustration featuring a message about revolutionary violence. In court, Nasr explained that their posts were a reaction to the perceived indifference of partygoers toward the struggles of the Palestinian people. They stated they do not condone violence against civilians. A contributor from Die Welt, Boris Pofalla, reported Nasr’s posts, leading to a criminal investigation that Nasr learned about in April.

Interviewer: Thank you for joining us, ⁤Edwin.⁢ Could‍ you share more ⁤about the context behind your Instagram posts?

Edwin​ Nasr: Thank ⁢you for having me. My posts were a response to the overwhelming sense of grief I felt watching the events unfold and the perceived apathy of many partygoers towards the ‍ongoing struggles of the Palestinian people. I ​aimed⁢ to provoke thought, but I understand now ⁢how my words could​ have been interpreted differently.

Interviewer: ‌During your court proceedings,‌ you ​expressed that you did not fully grasp the severity of the ⁤situation. ​How did that realization come about?

Edwin Nasr: It was ⁤a process. When I posted, I ‍was still‌ trying to process the emotional weight ‍of the attack. As the news developed, I recognized the ‌immense suffering of those affected, and I faced the ‌reality of ​how my expression was received. The legal consequences further amplified my understanding; I did not⁣ intend to trivialize anyone’s pain.

Edwin Nasr: ‌This case has highlighted ⁢the precarious nature of artistic expression in Germany. While I firmly ‌believe in⁤ the importance of free speech, it is equally​ crucial to acknowledge the​ impact that words can have. Many artists ⁣today feel constrained, fearing backlash or legal repercussions merely for expressing solidarity with oppressed ​communities, ‍which can⁣ stifle vital conversations.

Interviewer: Have you faced particular challenges in your ‍personal life due‍ to the scrutiny following your posts?

Edwin Nasr: Yes, the experience ⁢has been overwhelming. I’ve encountered significant‌ challenges with rent and employment since this investigation began. The media spotlight can be relentless, especially when it intertwines with ongoing complex political issues. It’s been a difficult time,‍ both personally ⁢and professionally.

Interviewer: How⁢ do you envision moving forward, particularly ‌in light of your‌ previous work, such as curating exhibitions?

Edwin Nasr: I intend to continue my work in the art community, but with a more nuanced understanding of the implications ‍of my voice. I want ⁢to cultivate spaces for‍ dialogue that ​respect all ‍perspectives, especially‌ those​ marginalized. The response to my posts has reinforced the importance of listening, learning, and acknowledging the ⁤nuances in advocacy.

Interviewer: what message ⁤would you like⁢ to convey to both artists and the public regarding the‌ ongoing debates around freedom of expression and activism?

Edwin Nasr: My hope is that we can foster an ⁣environment where honest discussions can ⁣thrive without fear of legal consequences. It’s vital ⁢for artists to feel that they can speak out about issues they are passionate about ‍without censorship. I encourage everyone to approach these conversations with empathy and an open mind, recognizing the complexities involved.

Nasr described feeling overwhelmed by the media scrutiny, especially amidst ongoing violence against Palestinians. They mentioned challenges in their personal life, including difficulties with rent and employment since the posts became public. Previously, Nasr curated a solo exhibition for Brazilian artist Jota Mombaça during Berlin Art Week in 2023.

Artists in Germany are currently facing pressures regarding freedom of speech when discussing Israel. Notably, several artists, including filmmaker Hito Steyerl, recently withdrew from a symposium due to ongoing criticisms and calls for boycotts related to state censorship of pro-Palestine expressions.
