Germany Passes Electricity Supply Security Act

The German Federal Ministry for Economic Affairs and Climate Action (BMWK) has enacted a new law to ensure electricity supply security, focusing on the establishment of a capacity market to stabilize the grid as the country phases out coal. The legislation, finalized on July 9, 2026, creates a framework to incentivize the maintenance and construction of power plants that can provide reliable backup energy during periods of low renewable output.

The law addresses a critical gap in Germany’s energy transition by shifting from a system based solely on energy production to one that pays for available capacity. According to the BMWK, this mechanism ensures that sufficient power generation remains online to prevent blackouts as traditional coal-fired plants are decommissioned.

Capacity Market Mechanisms and Grid Stability

Under the new legal framework, the German government is implementing a capacity market (Kapazitätsmarkt) to guarantee that power plants are available regardless of the immediate market price for electricity. This move is designed to provide investment security for operators of flexible power plants, such as gas-fired plants capable of switching to hydrogen.

The BMWK states that the law is a necessary companion to the coal phase-out (Kohleausstieg). Because wind and solar energy are intermittent, the capacity market pays providers to keep plants in “standby” mode, ensuring they can be ramped up quickly when demand spikes or weather-dependent generation drops.

Integration with the Coal Phase-Out Strategy

The legislation explicitly links supply security to the timeline of Germany’s exit from coal. As the government mandates the closure of coal plants, the risk of capacity shortfalls increases. The new law seeks to mitigate this by funding the transition to low-carbon, dispatchable power sources.

The BMWK indicates that the law will facilitate the deployment of hydrogen-ready power plants. These facilities are intended to replace the baseload and peaking capabilities previously provided by lignite and hard coal plants, aligning the goal of decarbonization with the requirement for a stable electrical frequency.

Business and Regulatory Implications for Energy Providers

For energy companies, the law changes the revenue model for power generation. Instead of relying exclusively on the spot market for electricity sales, operators can now access payments for simply guaranteeing their availability to the grid operator.

This regulatory shift reduces the financial risk for investors building new gas-to-power plants. By providing a guaranteed income stream for capacity, the government aims to attract the private capital necessary to build the infrastructure required for the next phase of the energy transition.

The law also introduces stricter requirements for supply security (Versorgungssicherheit), placing more rigorous obligations on operators to maintain their plants in a state of readiness. Failure to meet these availability targets may result in penalties under the new statutory framework.
